이 연구는 제주특별자치도 초·중등 교원을 대상으로 「학교자치조례」에 대한 법인식을 분석함으로써 교육당사자 중 교원의 공감대적 가치 질서를 밝히는데 목적을 두고 있다. 이 목적을 달성하기 위해 학교자치에 관한 교원의 법인식 수준, 학교 자치조례의 내용과 학교자치관련 법인식 수준에 대한 교원 집단간(학교급별·학교설립별·학교규모별·직위별·교육경력별) 차이, 교원의 법인식이 반영된 학교자치조례 제정 방향을 연구 문제로 설정하였다. 이를 위해서 제주특별자치도 내 19개교의 초·중등 교원 458명을 대상으로 광주·전북 학교자치조례 조항에 대한 동의 수준, 학교자치조례에 관한 현재 법인식에 대한 설문 조사를 실시하였다. 설문 결과는 기술 통계분석, 일원변량분석, Scheffe 검증을 수행하였다. 연구결과, 광주·전북학교자치조례 조항(내용)에 대한 제주특별자치도 교원의 법인식 수준은 평균 4.26 로 인식하고 있었다. 그리고 학교자치에 대한 제주특별자치도 교원의 현재 법인식 수준은 평균 3.52 로 인식하고 있었다. 또한 학교자치조례의 내용과 학교자치관련 법인식 수준은 1개 이상의 교원 집단간(학교급별·학교설립별· 학교규모별·직위별·교육경력별) 유의미한 차이가 있었다. 이러한 교원의 법인식 연구 결과를 바탕으로 법규범과 법인식이 조화를 이루는 학교자치조례 제정을 제안하였다.
The purpose of this study is to analyze teachers` legal cognition of Ordinance of School Autonomy In Jeju special self-governing province. This study presented it as research problems. 1st, What is the level of legal cognition of Ordinance of School Autonomy? 2nd, What is the difference between the teachers` groups on the contents and the level of teachers` legal cognition of Ordinance of School Autonomy? 3rd, What is the direction of enactment of Ordinance of School Autonomy reflecting the teachers` legal cognition? To achieve it, off-line survey was conducted on the members of teachers in Jeju special self-governing province, and 458 members responded the questions. Descriptive statistics, one-way ANOVA, Scheffe were conducted. Data analysis showed that teachers` legal cognition of Ordinance of School Autonomy contents was 4.26 on average. Teachers` legal cognition of the current legal status of School Autonomy was 3.52 on average. And There was a significant difference between the contents and the level of teachers` legal cognition of Ordinance of School Autonomy among more than one teacher group. Baesd on the findings, proposed the establishment of Ordinance of School Autonomy that harmonize the law and teachers` legal cognition
