이 연구는 중앙과 지방 사이의 교육행정권한 배분과 관련된 이론 및 실제 법령 현황과 함께 향후 요청되는 입법정책적 개선 방향을 모색함을 목적으로 한다. 교육행정권한의 배분방식은 각 국가마다 다양하지만 우리나라는 절충식 방식을 채택하고 있는데, 중앙과 지방 각각의 정부 기능이 명확하게 분리되지 않은 지방자치제도 그리고, 중앙 및 지방의 공동사무를 많이 규정해 온 관계법령의 태도로 인하여 중앙의 교육행정권한이 상대적으로 우위에 있음에도 불구하고 중앙과 지방 간 행정권한 경합 및 충돌의 문제가 나타나고 있음을 확인할 수 있었다. 이와 관련하여 중앙과 지방 교육행정권한의 바람직한 배분을 위하여 중앙과 지방의 공동권한으로 되어있는 현행법들의 입법태도에 대한 전면적인 재검토와 함께 기관위임 중심의 배분방식에서의 탈피, 가칭 「교육행정권한 이양에 관한 법률」의 제정을 통한 교육행정권한의 포괄적·일괄적 이양 도모, 체감자치가 가능하도록 중역단위 지방교육자치제로 전환 적극 검토 등의 입법정책을 제안하였다. 그리고 교육행정권한의 합리적 배분의 목적에 대한 깊은 성찰의 필요성을 제안하였다
The purpose of this study is to produce legislativ policy strategies for current legal system of the distribution of educational administration authority between central government and local government. For that purpose, this study implement systematic analysis for the current theories and laws. This study presents recommendations as follows: 1) Revision on the Local Education Autonomy Act for emerging from practices of joint authority and agency delegated affairs. 2) Establishing the so-called Educational Administration Authority Delegation Act to delegate the central level authority to the local level. 3) Actively considering meso-level system on local educational autonomy. 4) Devoting continued effort for enhancing the protection of educational basic right and the school autonomy through optimal balance between central and local government
