The purpose of this study is to find out the problems of the false and excessive lien rights by analyzing mainly the cases of the Supreme Court about the litigation cases caused by the false and excessive lien rights and to seek institutional measures to protect the good buyers Respectively.As a result of the analysis, the buyer s civil protection measures include the realization of the current survey and the improvement of the accuracy of the appraisal evaluation, the recognition of the right of repayment and the conversion to extinction, the reduction of the scope of cooperativeness and the registration of lien, Is needed. Secondly, the protection of the buyer through criminal settlement of falsification and extradition. According to criminal law, the act of a false or excessive lien can be classified into various types such as an auction, bid interception, a house invasion, a registration violation on the registration of a real estate owner, a compulsory execution deduction, , But the level of punishment should be increased as compared with the current level and the requirements for the establishment of crime should be relaxed.
