의무교육 수탁 사립 중학교를 운영하는 학교법인의 법정부담경비 부담 관련 법적 쟁점 분석

A legal analysis on the burden of school foundations that run the compulsory middle schools

이 연구는 의무교육을 수탁받은 사립중학교를 운영하는 학교법인의 법정부담경비 부담 주체에 관한 것이다. 현행 법률과 같이 학교법인이 부담하여야 할 것인가, 의무교육을 위탁한 지방자치단체가 부담하여야 하는가에 관한 논란은 이미 법원의 심판 대상이되고 있다. 이 연구에서는 사건 관계 법률의 구조를 확인하고 엇갈린 결론을 내린 두 개의 판결을 분석하였다. 연구 결과, 사건 대상 법률 조문에서 학교법인이 부담금을 지방자치단체에 청구할 수 있는 공법상 권리가 직접 발생하는 것은 아니라는 점을 논증하였다. 다만, 학교법인에 대한 지원 문제는 입법정책의 문제라는 사실을 확인하고, 재정 지원과 행정청의 관여라는 관점에서 사립학교를 유형화하고 부담금을 지원할 수 있는 대안을 제시하였다.

This study is about whether the school foundations, entrusted with running the compulsory middle school education, should be the main agent to take the burden of legally required expenses for the school operation. It has become a matter of judical judgment whether school foundations or local governments that have entrusted them with the compulsory middle school education should be chargeable on the burden of the expenses. This study confirms the legal structure of the cases and analysed the court`s two rulings that are contradictory each other. As a result of the research, it has been proved that the school foundations do not have the rights under public law to claim the legitimate expenses burdened from the local government. Yet, confirming that financial support for the school foundation is a matter of a legislative policy, this study suggests an alternative that through classifying private middle schools, the local government can financially supports the burden of expenses by the foundation in terms of financial support and an administrative intervention.
