미국, 영어권 국가의 교육복지 및 학생안전 입법사례 연구

A Study on Legislative Examples related to Education Welfare and Student Safety of the United States and English-speaking nations

최근 우리나라 교육계에서 교육복지(education welfare)라는 용어가 일반적으로 사용되고 있지만, 연구결과에 따르면 선진 주요국에서는 교육복지 용어 대신 학생안전이나 학생복지 등의 용어를 사용했다. 유일하게 아일랜드가 국가차원에서 교육복지법(education welfare act)을 제정하고 시행기구를 설치한 것으로 밝혀졌다. 또 주요국에서는 학교 안팎에서 발생하는 따돌림, 괴롭힘, 학업중단 등의 학교이탈 등을 학생과 학교의 안전과 교육복지에 심각한 위험요소로 간주하고 이에 관련된 법령을 제정, 시행하였다. 예를 들어, 미국과 캐나다의 경우 연방정부나 주정부에서 학교안전증진을 위해 개입할 명분을 위해 관련 법률을 제정했으며, 호주에서는 주정부에서 학생복지기준의 최소기준을 제시하여 학생에 대한 돌봄 책임과 학생복지 의무를 학교생활 전 영역으로 통합하였다. 특히, 이들 국가에서 제정한 교육복지와 관련된 법률들은 다양한 피드백과 엄격한 평가체제를 구축한 것이 눈에 띄었다. 이런 연구결과는 교육복지와 학생안전이 교육계의 최우선 과제로 대두된 상황에서 우리나라에도 유익한 시사점을 제공할 것이다.

Attention to bullying and violence in school by policymakers and the public is a very recent phenomenon. Parents and students want all schools to be safe place where children wanted to go to learn. But school has become a very dangerous place. Specially, It was not until 1999 that USA, spurred by a highly publicized bullying incident resulting in the death of middle school student, enacted student and school safety-related federal acts. The problem is that such bullying and violence in classroom or school playground intimidate school and student as well as destroy school function. Now education welfare includes safety of student and school, USA and English-speaking nations have tremendous interests in making safe schools. For example, Safe Schools Improvement Act of USA(2013), Education (Welfare) Act of Ireland(2000), Keeping Our Kids Safe at School of Ontario, Canada(2009), Minimum Standards, Victoria, Australia(2007) are representative of legislative trends of advanced nations. Those nations provide various feedback and strict evaluation system on the education welfare-related laws. According to the research Ireland only among the English-speaking nations including USA uses education Welfare Act.
