대학교원 재임용 관련 교원소청심사위원회 결정 내용 분석

An Analysis on the Decision Contents of Appeal Commission Concerning Reappointment of University Faculty

본 연구의 목적은 대학교원의 재임용 거부처분에 대한 교원소청심사위원회의 결정내용을 분석하는 것이다. 이를 위해 교원소청심사위원회에서 발간하는 결정문집에 수록된 대학교원 재임용 관련 소청사건 54건을 대상으로 청구 및 결정 현황, 결정 내용을 분석하였으며, 연구결과는 다음과 같다. 첫째, 청구 및 결정 현황에서, 결정문집에 수록된 사례의 청구인은 모두 사립대학 교원이며, 청구인의 주장을 받아들이는 구제율은 77.8%로 전체 소청사건 평균 구제율42.5%보다 상당히 높게 나타났다. 둘째, 결정 내용의 특징으로, 재임용 심의절차 준수여부, 재임용 평가기준으로 정성적 기준보다 정량적 기준 중시, 연구윤리 중시, 근무태도를 재임용 거부의 중요 사유로 간주하지 않음 등이었다. 이와 같은 연구결과를 바탕으로 재임용 심의기준의 객관성과 공정성 확보 및 재임용 심의절차 준수, 대학의 교원소청심사위원회 결정 내용 수용, 청구사건 전체정보 제공 등이 필요함을 제안하였다.

This study aims to analyze the decision contents of Appeal Commission for Teachers Concerning disapproval of reappointment of university faculty. To do this, 54 appeal cases from the Book of Decision published by Appeal Commission for Teachers were analyzed in view of appealing cases, decision status and contents. And the founding of this study is provided as below. First, in the view of appealing cases and decision statues, all cases from the Book of Decision were appealed by teachers from private universities and ratio of relief, which means that appeal was accepted, was 77.8%. This was significantly higher than 42.5%, average of overall appealing cases. Secondly, decision contents are featured with; compliance with reappointment reviewing and decision process and standard, placing more on quantitative features rather than qualitative features when it comes to decide reappointment, and placing more emphasis on research ethics. Moreover, the performance attitude was not considered for the ground for rejections. From the founding of the study, it is suggested that objectivity and fairness of decision criteria, compliance of reappointment decision process and standard, acceptance of the decision of Appeal Commission for Teachers by the universities, provision of information on overall appeal cases be secured.
