교사는 부모보다도 더 많은 시간을 어린이와 함께 할 정도로 밀도 있는 접촉을 하는 지위에 있으므로 아동학대를 막는 중요한 역할을 할 수 있다. 이 글에서는 우선 교사에게 아동학대를 보고하도록 요구하는 연방법률과 州법률들의 내용을 분석한다. 대부분의 州법률은 연방법률인「아동학대방지 및 치료에 관한 법률(Child Abuse Prevention and Treatment Act, CAPTA)」상의 연방자금 지원에 영향을 받아 제정된 것이다. CAPTA 는 국립학대아센터(National Center of Child Abuse and Neglect)를 설립하여 학대아(虐待兒)에 관한 정확한 정보를 얻기 위한 연구를 하고, 州와 지방적 단체들에게 기술적 정보와 훈련을 제공할 것을 규정하고 있다. 또한 각 州법률은 아동학대 신고의무자를 규정하고 신고의무자의 아동학대 신고행위에 대해서는 면책(免責)을 규정하고 있다. 면책의 내용은 각 州에 있어서 다소 차이가 있다. 우리의 경우도 2014. 1. 28.로「아동학대범죄의 처벌 등에 관한 특례법」을 비롯하여 아동복지를 위한 법제가 미국의 경우에 뒤지지 않을 만큼 상당한 수준으로 완비되어 있다고 할 수 있다. 그럼에도 불구하고 아동학대의 예방과 아동의 보호 정책의 수준이 미국의 그것에 훨씬 못 미치는 이유는 법제의 불비에 있는 것이 아니라 법치의식의 이완 (弛緩)에 기인하는 것으로 보인다. 현행 법제도를 엄격하게 시행하는 것이 중요하다는 사실을 인식할 필요가 있다.
Educators` primary responsibility is to promote the welfare of the children in their care. It is essential for educators to be properly trained to recognize child abuse and know the appropriate actions to be taken when a child is being abused. Educators can play an imperative role in preventing or stopping child abuse because they are in a position to spend so much time with children more than some parents. This paper will analyze the legal contents of federal law named CAPTA(Child Abuse Prevention and Treatment Act) and state laws most of which are enticed by CAPTA for federal grants requiring educators to report child abuse. CAPTA enacted a provision allowing for establishment of the National Center of Child Abuse and Neglect, which took the focus of procuring information respecting child abuse through research. It also aimed to provide states and local entities with technical support and training. States can receive financial support from federal government by complying with relative regulations. The financial support is to aid stats with the costs involved with prevention and reporting programs regarding child abuse. CAPTA and state statutes provide for professions` duty to report child abuse and immunity to reporters of child abuse. The immunity varies in states. In Korea, there is a recent legislation named Act on Special Cases concerning Punishment of Child Abusers of which enforcement is timetabled for the end of September this year. This law is as substantial as the U.S. CAPTA in terms of contents. Nevertheless the level of prevention of child abuse and intervention of care services for child is below those of the U.S, which is caused by relaxation of constitutionalism. It is imperative that we realize the importance of the strict enforcement of existing law.
