학원과 학습지 표준약관 개선방안 연구

본 연구는 학원과 학습지 시장에서 소비자 피해 방지 및 소비자 권익 향상을 위해 표준약관의 개정방향을 모색하는 것을 목적으로 하고 있다. 학원 표준약관은 전반적인 용어 정리가 필요하고, 계약 체결 전 정보제공과 광고에 관한 내용의 보완이 필요하며, 최근 개정된 학원법 및 소비자분쟁해결기준에 따라서 교습비반환사유와 반환금액 기준이 새롭게 마련되어야 한다. 학습지 거래에서는 학습지의 대금을 할부로 납부하는 경우에 할부거래법이 적용되고, 방문판매사원을 통하여 계약체결이 이루어는 경우에 방문판매 등에 관한 법률이 적용되므로, 양 법률을 동시에 일 관성 있게 고려하여 표준약관을 보완해야 한다. 이와 함께 계속거래 등의 해지·해제에 따른 위약금 및 대금의 환급에 관한 산정기준도 정비되어야 한다.

The purpose of this study is to research the improvement plan for standardized agreement of private educational institute(hakwon) and home-school teaching material market to protect consumers and advance comsumer rights and interests. This study examines the dispute cases in cooperation with ``Korea Consumer Agency`` and reviews the precedent researches and relevant laws. In addition, this study collects and analyzes the agreements of the current private educational market. Following these findings. this study suggests the improvement plan for standardized agreement of private educational institute and home-school study material market. The improvement plan for private educational institute`s standardized agreement is as follows. First, it is necessary to amend the terminologies in the standardized agreement. Second, new standardized agreement should contain these contents: compulsory information offering to the clients before the conclusion of a contract; the guidelines of training fee refund according to the recently revised act of private educational institute and consumer dispute settlement regulations. The improvement plan of home-school teaching material`s standardized agreement is as follows. First, new standardized agreement should consider ``Installment Transaction Act`` and ``Door to Door Selling Act`` at the same time. In addition, the standard criteria of cancelation charges and payment refunds should be reexamined. Finally, this study suggests some effective ways for using standardized agreement.
