이 연구는 학교폭력 예방 및 대책에 관한 법률이 학교폭력 예방과 대책을 위하여 어떠한 모델과 내용을 갖고 있는지 분석학고 입법적인 개선 방안을 제시하는 것을 목적으로 하였다. 최근 이 법률의 개정과 학교폭력의 여러 대책에도 불구하고 근본적인 해결 방안으로 부족하다는 비판이 많다. 이것은 학교폭력에 대해 가해 학생에 대한 배제와 사후 대책 중심의 해결에만 중점을 두고, 학교폭력의 구조적인 원인과 동법의 근본 취지를 무시하였기 때문이다. 또한 동법이 해결하려는 학교폭력의 범위가 너무 넓고 학교폭력 자치위원회의 구조와 기능에도 한계가 있기 때문이다. 이를 해결하기 위해서는 학교 단 위에서는 학교폭력의 사후적·사법적 판단 모델 또는 가해 학생의 배제 모델보다는 예방교육과 조정 중심의 모델, 회복적 정의 모델로 제도를 운영해야 하다. 그리고 사법적 판단은 지역 단위 또는 사법 기구에서 판단하는 것이 바람직하다고 보아 자치위원회의 구성과 기능도 재검토할 것을 제시하였다. 아울러 학교폭력 해결 방식에 있어서 초등학교와 중등학교의 구별, 예방 교육의 구체화, 지역 단위의 해결 노력, 교사의 권한과 재량 을 강화하기 위한 지원 방안 등도 입법적으로 개선되어야 함을 제안하였다.
This paper is aimed to analysis of models and contents for prevention and countermeasures of 「the Act on the Prevention and Countermeasures against Violence in Schools」to suggest lawful improvement measures. Lately, there has been a lot of criticism that the revision of laws and countermeasures for school violence does not present fundamental solutions. The problem continuously arises because an offender i excluded and the focus is on action after the fact, ignoring structural reasons for schoolviolence. Also the framework and function of a school violence self-government committee are limited. In order to solve the problem, schools themselves should adopt a lawful post-action model or prevention education and adjustment-focused model instead of excluding offenders, therefore demonstrating a justice recovery model. And, jurisdictional decisions should be made by areas at local institutes. The constitution and function of a self-government committee should also be reviewed. In addition, support measures should be improved lawfully in distinguishing between elementary and middle schools, embodiment of prevention education, efforts for solutions by local areas, and reinforcing authority and capabilities of teachers.
