이 연구의 목적은 교원의 품위유지의무 위반에 관한 교원소청심사위원회 결정 현황 및 결정 경향을 분석하여 시사점을 찾고자 하였으며, 연구결과는 다음과 같다. 첫째, 청구 현황에서 품위유지의무 위반 유형 중 성(性) 범죄, 폭행 및 폭언의 비중이 높았다. 둘째, 결정 현황에서 전체 소청사건 구제율보다 품위유지의무 위반 소청사건의 구제율이 상당히 낮았으며, 특히 성(性) 범죄와 교통질서 위반 구제율이 매우 낮았다. 셋째, 결정 경향에서 전체 소청심사 결정이유로 법률 위반 여부를 중요한 기준으로 적용하고 있었다. 넷째, 하위유형별 결정 경향의 특징으로, 성(性) 범죄는 대상이 학생이나 동료교직원일 경우 구제율이 매우 낮았고, 폭행 및 폭언은 사립교원의 구제율이 상당히 높았다. 이와 같은 결과를 바탕으로, 교원의 품위유지의무 위반 징계양정 기준의 구체화, 사립교원 징계위원회 심사과정의 전문성과 객관성을 제고할 수 있는 제도적 방안 마련 등을 제언하였다.
The purpose of this study was to find implications by analyzing the decisions of Appeal Commission for teachers about the teacher`s violation of dignity maintenance duty and its decision tendency, The result of this study is as in the following, First, as for claim condition, sexual assault, attack, and abusive language were of great importance out of types of violation of dignity maintenance duty, Second, as for decision condition, the relief rate of violation of dignity maintenance duty appeal cases was significantly lower compared to that of total number of appeals, Third, as for decision tendency, the truth of an offense against the law was regarded as an important criterion due to the decision reason of the total appeal screening, Forth, as one of the characteristics of decision tendency by subordinate types, when the object of sexual assault was a student or a colleague teacher, their relief rate was very low, On the other hand, the relief rate of teachers of private school was significantly high when it comes to attack and abusive language, Based on these results, this study came up with effective counter-plans such as actualization of the standard of disciplinary action of teacher`s violation of dignity maintenance duty, and the ways to enhance professionalism and objectivity,
