교육규제완화의 한계와 통제

The Limits and Control of Deregulation of Education

교육규제와 교육규제 완화는 동전의 양면과 같은 것이다. 교육규제와 교육규제 완화 모두 헌법상 보장된 국민의 교육받을 권리를 보장하기 위한 수단에 불과하다. 다만, 어떤 상황에서는 규제가 요청되는 경우가 있고, 또 다른 상황에서는 규제 완화가 요청되는 경우가 있을 뿐이다. 교육규제가 법적 원리를 준수하여야 하는 것과 마찬가지로 교육규제 완화 역시 법적 원리를 준수하여야 한다. 교육규제에 한계가 존재하고 통제 받아야 하는 것과 마찬가지로 교육규제 완화 역시 한계를 설정할 수 있고, 적절한 방식으로 통제되어야 한다. 교육규제 완화는 교육규제 유형을 불문하고 다음과 같은 한계를 지닌다. 첫째, 규제 상황보다 국민의 교육받을 권리를 후퇴시키지 않는 범위에서 규제 완화가 이루어져야 한다. 둘째, 비례 원칙을 준수하는 범위에서 규제 완화가 이루어져야 한다. 셋째, 교육제도 법정주의와 배치되지 않는 범위에서 규제 완화가 이루어져야 한다. 이밖에 규제 영역과 유형에 따라서 특수한 한계를 설정할 수도 있다. 교육규제완화는 입법적, 행정적, 사법적으로 적절히 통제되어야 한다. 입법자는 법률 개선의무를 성실히 이행하여야 하며, 행정적으로는 행정규제기본법상의 통제 등을 시행 할 수 있다. 헌법소원심판 등을 통한 사법적 통제도 가능하다.

Deregulation of education means breaking the government`s monopoly of the provision and management of education by giving free hand to private participation in the provision and management of education. In the legal aspect, deregulation means that governmental rules and regulations governing the operations of the system are relaxed or held constant in order for the system to decide its own optimum level through the forces of supply and demand. Regulation of education is in order to embody constitutional spirit. So is deregulation. As regulation of education should be under constitutional control, so is deregulation of education. It is the aim of this study to establish clear-cut lines of possible scope of deregulation of education and clarify control of deregulation of education. Deregulation should be under constitutional control as follows. Deregulation should not pursue the efficiency of administration or private benefit at the expense of the guaranteeing of the right to education of people. Deregulation also should comply with the principle of minimal infringement. Finally, the nullification of rule of law by deregulation of education is not allowed. The legislative, administrative and judicial control devices for ensuring sound deregulatory law in education field were proposed.
