본 연구에서는 학교지원체제로서의 행정실의 역할을 명료화하기 위해 관련 법제를 어떻게 정비할 것인지를 검토하고, 법률, 조례, 규칙 등의 법령체계 가운데 행정실의 법적 근거를 어디에 두어야 할 것인지를 판단하기 위한 논리적 기초와 대안을 마련하고자 하였다. 현행 규정을 검토한 결과, 첫째, 행정직원을 둘 수 있는 근거와 인사에 관해서는 `초·중등교육법`에 명시되어 있으나 행정조직인 행정실의 설치, 운영, 직무 범위 등에 관하여서는 언급이 없고, 둘째, 행정조직의 명칭이나 직무 등이 지방자치단체의 규칙 형식으로 존재하나 체계성이 없으며 법령에도 근거가 없어 법치주의에 반할 소지가 있다는 점 등의 문제가 있는 것으로 나타났다. 단위학교 행정실 관련 법제 개선방안 마련을 위한 주요 쟁점은, 관련 법령들이 시·도교육감의 규칙으로 충분한지, 초·중등교육법에 근거 규정을 마련하여야 하는지에 있다. 본 연구에서는 학교 행정실의 설치·운영이 중앙정부가 담당해야 할 기본적인 국가교육제도의 일부로 판단하고, 행정실 설치를 법률로 의무화하기 보다는 지방자치단체에서 자율적으로 결정하도록 근거 조항만 `초·중등교육법시행령`에 마련하는 안을 제시하였다.
This study examines in which manner the relevant laws and ordinances should be modified in order to clarify the role of school administration offices and also provides logical groundwork and alternative plans to determine in which legislative systems (e.g. act, ordinance, regulation) the legal basis for school administration office should based on. The following problems were found as a result of review of current regulations on the issue. First, the `Elementary&Secondary Education Act` states the grounds of employment and personnel management but it does not state the installation, operation, and scope of duty of the school administration office, so it can be against the rule of law. Second, title and duty of administrative organizations exist in the form of regulation of local autonomous entities, but is not sufficiently organized and also there is no legal basis in the law which may lead to departure from constitutionalism. The major issue on the legislation of school administration office is to determine whether if the rules enforced by municipal or provincial superintendent of educational affairs is sufficient or if there is a need to establish a new regulation based on the `Elementary&Secondary Education Act`. The course of action suggested in this study is to recognize the installation and operation of school administration office as a part of basic national educational system required by the central governmen to take charge of, add relevant items to the `Elementary&Secondary Education Act` rather than enforcing the installation of administration office by law and allow local autonomous entities to decided the details at their discretion.
