교육기본법의 성과와 과제: 기본법론의 관점에서

The Accomplishments and Prospects of Educational Basic Law in Korea

교육기본법이 시행된 후 십여 년이 경과한 시점에서, 교육기본법 제정의 성과와 과제를 분석하였다. 교육기본법 제정 후의 변화상을 파악하기 위하여 교육기본법 개정 과정을 개관하고, 교육기본법에 관한 학계의 논의와 후속 입법을 검토하고, 교육 재판에서 교육기본법의 인용 사례와 지난 시기의 교육정책을 개관하였다. 본 논문에서는 교육기본법의 성과와 과제를 ``기본법``이라는 관점에서 파악하고자 하였다. ``기본법``에 관한 일반 논의를 토대로 교육기본법의 성과와 과제를 추출하여는 바, 교육법 체계의 정비, 사회 구성원의 법 의식 증대, 헌법 정신의 구현, 교육 당사자들의 권리의식 제고, 교육제도 법정주의 정착 등을 교육기본법 제정의 성과로 파악하였다. 한편, 지나치게 잦은 개정, 교육기본법의 효력에 관한 문제, 교육 당사자간 갈등의 조정 기제의 문제, 교육의 다양화와 세계화 등으로 인한 교육기본법의 내용 정립의 문제 등을 ``기본법``으로서 교육기본법이 당면하고 있는 과제로 제시하였다.

This thesis examined the accomplishments and prospects of Educational Basic Law of Korea looking back on over ten years since the law was enforced. The following four works are carried out in order to grasp the changes caused by the law: to investigate the revision processes of the law, to review the discussions of the academic circle over the law, to examine the trials in which the clauses of the law were quoted or litigated, finally, to outline the education policy agendas over the last ten years. The followings can be achievements of the law: to make various education laws improve in terms of the structure of education law, to promote citizen`s sentiment on law, to make constitution establish in the field of education, finally, to settle the consciousness over the rights and duties of the person concerned on education. On the other hand, two problems were manifested. First, the frequent revisions of the law damnified the law as the basic law of education. Second, the discussion over the force of the law has been in succession. Furthermore, the law may confront the new tasks because of the change of education policy environment of Korea. Namely, with the deepening of globalization and diversification of Korean education, it might be more and more difficult to fix basic elements of various phases of education.
