교육재정법제 연구의 성과와 과제

Products and Tasks of the Research on Legislative System related to Educational Finance

이 연구는 지난 20여년간 이루어진 교육재정법제에 대한 연구의 성과를 분석하고 과제를 제시할 목적으로 수행되었다. 이를 위하여, 먼저 교육재정법제의 형성과 발전과정, 교육재정법제 연구의 성과, 교육재정법제 관련 판례의 동향 등을 고찰한 후, 교육재정법제 연구의 과제로 현행 교육재정법제에 대한 정비방안 연구의 지속, 교육재정법제의 신설방안 연구, 교육재정 판례에 대한 연구·분석 강화, 교육재정법제 연구의 다양화 등을 제시하였다. 정비가 필요한 교육재정법제로는 「지방교육재정교부금법」, 「학교용지확보 등에 관한 특례법」, 「사립학교법」 등이었으며, 신설이 필요한 교육재정법제로는 「국가와 지방자치단체 등의 교육비 부담에 관한 법률」, 「고등교육재정교부금법」, 「사립학교지원법」 등이었다. 교육재정 관련 판례에 대한 이론적 분석에 보다 많은 관심이 필요하며, 교육재정법제에 대한 연구대상의 다양화와 함께 법철학적 분석방법에 보다 많은 관심이 필요함을 제안하였다.

The purposes of this study are to analyze products of the research on legislative system related to educational finance(LSEF) and to suggest tasks for the future study. To accomplish the purposes, the process of the enactment and the development of LSEF was reviewed, the tendency of precedents of LSEF was checked, products of the research on LSEF were analyzed, and the tasks for the future study were suggested. The suggestions are as follows. First, the measure to improve the LSEF, for examlple, the Financial Grant Law for Local Education, the Special Law for Securing the School Land Aquisition, and the Private School Law, should be researched continuously. Second, the study of the new enactment of LSEF, such as the Law of Educational Expenses Share with Central Government and Local Government, the Financial Grant Law for Higher Education, and the Financial Support Law for Private School, should be added. Third, the study of the precedents of LSEF should be concentrated. Last, the scope and method of the research on LSEF should be diversified.
