대학정보공시제의 법제화 방안 연구

A Study on the University information Disclosure System

날로 가속화되는 정보화, 민주화, 개방화 물결로 인해서 대학에 관한 정보 수요가 급증함에도 불구하고, 이들 정보가 충분히 공개되지 않아서 학생, 학부모, 그리고 기업체 등이 학교 선택, 인력 충원 시에 정확한 정보에 기초한 결정을 내리는 데 어려움을 겪고 있다. 이에 본고에서는 대학의 교육·연구에 관한 주요 정보를 공개하여 국민의 알권리를 적극 보장하고, 더 나아가 대학경쟁력의 전제라고 할 수 있는 대학 경영의 효율성과 투명성을 제고하기 위해서 대학으로 하여금 주요 정보를 의무적으로 공시하게 하는 `대학정보공시제의 법제화 방안`을 제시하였다. 이를 위해서 정보공시와 관련된 선행 연구, 현행 법령 등과 함께 외국사례를 분석하였다. 분석 결과를 토대로 대학정보공시제의 법제화 방안을 제시하면 다음과 같다. 첫째, 공시주체별로 공시의무를 적절히 부과하는 것이 필요하다. 즉, 행정기관인 국공립대학과 비 행정기관인 사립대학의 차이를 고려하여 공시의무를 부과할 필요가 있다. 아울러, 대학 설치자와 학교의 장을 구분하여 공시의무를 부과할 필요가 있다. 둘째, 대학의 설립유형별 특성과 프로그램 특성을 고려하여 공시 범위를 정해야 한다. 이를 위해 모든 대학이 공통으로 공시해야 할 정보와 대학 유형별로 추가적으로 공시할 정보를 구분하는 것이 필요하다. 셋째, 공시 정보의 신뢰성을 확보하기 위해서 정보공시에 관한 실태조사를 실시하고, 유관기관간의 정보검증 및 협조 시스템을 구축해야 한다. 마지막으로, 비공시 및 허위 공시에 대한 대응방안을 정보청구권자 개인과 대학정보공시제 집행기관인 정부 차원에서 각각 마련할 필요가 있다.

This study aims to develop a proposal on the Legislation of the University Information Disclosure System, which will not only help realize the public`s right to know the quality of university and its managerial performance, but also will help upgrade the transparency of university management. To this end, the previous studies on information disclosure and related laws were analyzed. In addition, cases of USA and Japan were examined for the purpose of international comparison. Based on the analyses, a proposal on the Legislation of the University information Disclosure System was suggested as follows. First, in specifying who is responsible for disclosing university information, the differences between public universities and private ones should be considered. Especially, the differences in roles of the owner and the president of the university in disclosing information should be considered. Second, the range of the information disclosed should be determined on the basis of types of university and its programs. Accordingly, the information disclosed by all the universities and the ones by certain types of universities should be identified, respectively. Third, it is important to create methods to guarantee the reliability of the information disclosed by universities. For this purpose, the sampling survey of universities can be conducted to make sure that the information is correct. Besides, it is necessary to create a network of institutions related to university information, which ensures the reliability of the information through exchange of information on universities. Lastly, it is necessary to develop ways to deal with universities which disclose incorrect information or refuse to disclosing information.
