A Study on the Tendency of Research in Educational Law(2)

이 논문은 해방 후 한국에서의 교육법 연구동향을 박사학위논문, 관련 학회의 연구 동향, 교육법 관련 저서 및 보고서 등을 중심으로 분석한 것이다. 먼저 교육법학의 학문적 성격에 대한 논의를 기반으로 연구사를 학회출범 이전의 교육법규 해설 연구기, 교육법학 도입 연구기, 그리고 학회 출범 이후의 교육법학적 접근 연구기는 전기 및 중기로 나누어 살펴보았다. 분석 대상은 박사학위논문, 대한교육법학회의 「敎育法學硏究」와 한국교육법학회의 「韓國敎育法硏究」 학술지 이다. 교육법 연구의 성과로는 51편의 교육법 관련 박사학위 논문의 경향을 주제 영역별, 연구 방법별, 연도별 특징으로 나누어 살펴보았다. 학술지 논문은 2006년 9월까지 교육법학연구지(198편)와 한국교육법학연구지(52편)를 분석했다. 교육법 연구 과제로 학문적 구심점으로서 학회의 역할, 교육법학의 학문적 정체성 확보 과제, 교육법 쟁점에 대한 ``학설``의 제공, 학제적 접근방법의 시도, 교육기본법 정신에 대한 탐구, 연구 역량의 결집, 그리고 교육법 연구 2세대의 과업 등을 제시하였다.

The purpose of this study is to analyze the history of research about Educational law since 1945. In the view of developing in the Law of Education, I tried to describe the historical fact and evaluated the meaning of bibliography. I have published the article A Study on the Tendency of Research in Educational Law (The Journal of Law of Education No.9. 1997). This paper is it`s following. The subjects of this research included doctoral thesis, Journals of Law of Education, research reports, and books related with Educational law, which published from 1945 to 2006. So, this paper means evaluating-report on the academic results of Education Law in Korea. The history of research about Law of Education is can be divided into 3 phase. I named the first research-history period(until the middle 1970s) as a phase of interpretation about educational law. next research-history period(until the middle 1980s) as a phase of introduction of Law of Education, and last period research-history(until now) as a phase of approach of Law of Education. In this paper, I described the last period as the former and middle term. Through the Journal of New Education (1976.6), the word of ``Educational law`` introduced by professor An, ki-sung. He emphasized the necessity of approach of Educational Law. The academic society was founded in middle 1980s. the one is Korean Educational Law Association (1984.11), the other is The Korea Society for Educational Law (1986.9). The latter is main academic society in the sight of the number of members or results of it`s academic research. The doctoral thesis are published through the topic of 51. And, Journals of Law of Education is consisted of 198 pieces of articles. As a conclusion, suggestions which I can get from this study are as follows. The first tasks of Educational Law is to develop the academic identity, produce the theory or schools, try to inter-disciplinary approach, research the spirit of Basic Education Law, and publish the dictionary of educational law, etc.
