법학교육방법론에 대한 소고

Pedagogical Methods in Legal Education

법학전문대학원의 설립목적은 사회에서 요구되는 자질과 능력을 갖춘 법조 인력을 육성하는 것으로 현재의 법학교육방법으로는 이러한 목적을 달성할 수 없다. 본 논문에서는 새롭게 설립될 법학전문대학원의 교수들이 사용할 수 있는 법학교육방법론을 제시하고자 현재 논의되고 있는 법학교육방법론을 종합적으로 비교·분석하였다. 하나의 교육방법론이 법학교육에 내재하는 모든 문제를 해결할 수는 없기 때문에, 논문에서 제시된 다양한 교육방법을 교육의 목적과 교과내용에 따라 선택적으로 사용하면서 오디오와 비주얼을 통한 교육이나 컴퓨터프로그램을 통한 교육을 보조수단으로 병행한다면 법학교육의 질이 향상될 수 있을 것이다. 이러한 다양한 교육방법을 도입하기 위하여 법학교육연구위원회와 같은 기구를 설치하여 교육방법론에 대한 연구를 선행하는 것이 법학전문대학원제도의 성공적인 정착을 위한 선행조건이다.

In Korea, a broad and sweep reform of the justice system is now taking place. It is aimed at reinforcing the function of justice in the increasingly complex and diversified Korean society and realizing an accessible and user-friendly justice system that can respond to the expectation of the people and meet their trust. One of the main goal of the reform is to expand the quality and quantity of legal professionals. To achieve this goal while ensuring legal professions with suitable quality to undertake the administration of justice in the 21st century, Korean government has tried to establish graduate schools specializing in the training of legal professionals. The purpose of the article is to explore the value of several pedagogical methods in legal education; lecture, PBL, simulation. This article asserts that to be the most effective, law teachers need to be aware of a wide range of different pedagogical methods available to them, and to use those methods which best meet the educational goals of the course they are teaching.
