미국교육법 연구의 최근 동향과 쟁점

The Recent Trend and Current Issues in the Field of American Education Law

본 논문의 목적은 미국 교육법 연구의 최근 동향과 쟁점들을 분석하는 것이다. 최근의 연구동향 및 주요 쟁점은 미국 교육법연구의 대표적 학회인 ELA의 2006년도 학술대회 발표주제들, 그리고 미국 교육법의 대표적인 논문집인 「West`s Education Law Reporter」와 「Journal of Law & Education」에 게재된 2005-2006년도의 논문주제들을 종합 분석하여 선정하였다. 이러한 분석 결과 최근의 핵심적인 미국 교육법 쟁점으로 첫째, 장애아동의 교육(IDEIA)에 관한 관계 법령의 주요내용과 쟁점이 되고 있는 판례를 살펴보았다. 둘째, NCLB(No Child Left Behind Act of 2001)의 주요내용과 원칙을 살펴보고, NCLB의 위헌성 문제를 분석하였다. 셋째, 학교환경의 안전성과 학생지도 문제로 학교에서의 폭언과 폭력, 괴롭힘, 수색과 체포의 법적 문제들을 살펴보았다. 마지막으로 이러한 쟁점들이 한국의 교육법 연구에 주는 시사점을 몇 가지 지적하였다.

This article analyzed the recent trend of studies in American education law and the current issues. The current issues were selected from the comprehensive analysis on the topics of the 52nd National Conferences of the Education Law Association (2006 Year), and the whole articles published during the 2005 and 2006 in the 「West`s Education Law Reporter」 and 「Journal of Law & Education」. As the first current issue, this article analyzed the brief contents, legal issues and related legal cases of IDEIA(The Individuals with Disabilities Education Improvement Act of 2004). The legal issue was focused on the evidence of IEP(Individual Education Program) under the IDEIA. Second, this article analyzed the brief contents and the four principles of NCLB (No Child Left Behind Act of 2001). The current issues and legal cases were focused on the unconstitutionality of conditions such as adequate early progress under NCLB. Third, this article covered the issues of the school security such as threat, fighting word, verbal assaults, bullying and sexual harrassment. The T.L.O. case was also referred in the contexts of search and seizure in the school campus. The author suggested several implications to Korean education policy makers from the four issues of the American education law.
