사립학교법제에 관한 기초 연구

A Study on the Korean Legislative System related to Private Schools

이 연구는 사립학교법의 본질적 의의와 성격, 관계법령의 변천과정, 헌법재판소 판례에 대한 분석들과 함께 학자들 사이의 대표적 논쟁 사항에 대한 분석 등 사립학교법제 영역에 있어서의 포괄적 검토를 담고 있다. 이러한 연구는 우리나라 사립학교법제 그 자체 및 이에 대한 연구의 발전과정과 그 성과를 살펴보는 기회가 됨으로써 향후 법 정비 및 후속 연구에 있어서의 의미있는 이론적 기초 및 과제를 제공할 수 있을 것이다.

The Private School Law amended in 2005 has exposed critical conflicts in Korean society. The basic aim of this study is to present a theoretical base for solution of critical conflicts on The Private school Law through various research approach in educational law. And it targets to assign tasks to following study on legislative system related to private schools. The contents of this study are as follows. First, this study analyzes the fundamental meanings and characters on legislative system related to private schools. Second, it investigates the process of amendment of the legislative system related to private schools. Third, it demonstrates the reality of law recognition and possibility of judicial guarantee of the Constitutional Court by studying its judicial precedents regarding freedom of private school education. Finally, it examines the arguments of theories regarding the legal state of private school, the character of private school education, the legislative system related to private schools
