본 연구는 ｢예술인복지법｣의 초기 입법과정에서 야심차게 제기되었다가 국회 논의과정에서 삭제된 ‘예술인 근로자 의제’의 의미와 역할에 대해 다시 고찰하였다. 예술인 집단을 위한 별도의 사회보장체계를 정립해야 하는 정당성의 근거를 예술인 노동특수성으로 인한 경제적 허약성과 예술인 활동이 사회에 기여하는 긍정적 외부성의 두 가지로 도출하고, 유네스코의 <예술인의 사회적 지위를 위한 권고> 및 주요 유럽 국가들의 예술인 사회보장제도 체계의 근간에 위의 두 가지 요소가 자리하고 있음을 확인하였다. 이를 토대로 한국적 상황에서 ‘예술인 근로자 의제’는 예술인 노동 특수성 및 예술인 활동의 사회적 가치를 동시에 드러내는 의미와 역할을 지니고 있었음을 확인하고, 실제｢예술인복지법｣ 입법 및 개정 과정에서 ‘근로자 의제’의 함의가 충분히 이해되지 못했음을 지적하였다. 결론으로는 향후 ｢예술인복지법｣의 발전을 위해 고용형태에 상관없이 전문예술인들이 공통적으로 경험하고 있는 예술인 노동 특수성과 그로 인한 경제적 허약성에 다시 주목할 필요성을 제기하였다.
The paper aims to rethink the meaning and the role of the legal fiction of artists as worker, which was included in the initial bills of the Artists’ Welfare Act. For this, the research first articulates two major factors that explain the legitimacy to introduce a separate social security system for artists: the economic vulnerability of artists due to the specificity of artists’ work, and the positive externalities of artists’ activities. The paper then observes that the majority of well-established artists’ welfare systems in Europe are based on the importance of above two factors, as well as the UNESCO Recommendation concerning the Status of the Artists. Based on this, the paper argues that the previous attempts to bring legal fiction of artists as worker during legislation process had a very crucial role to reveal the need to understand the specificity of artists’ working process and the positive externalities of their activities. After identifying that the legislative process of the Artists’ Welfare Act was unsuccessful to fully acknowledge the undertone of the initial content of the bill, the paper argues that there is a need to refocus on the specificity of artists’ work and the economic vulnerability, which are experienced by the majority of professional artists, regardless of employment status.
