자율주행자동차 교통사고의 민사책임에 관한 법제 및 개선방안

Legislative Systems and Improvement Measures for Givil Liability in Traffic Accidents Involving an Autonomous Vehicle - With a focus on the Act to Guarantee Compensation for Loss Caused by Automobiles and the Product Liability Act

국·내외 유명 자동차·IT기업은 물론 대학교와 스타트업들이 자율주행자동차의 본격적인 상용화와 관련기술 고도화를 위해 연구·개발에 매진하고 있다. 자율주행지동차산업의 선도국가인 미국에서는 ‘테슬라’에 의해 부분적 자율주행(오토파일릿 기능)이 가능한 승용차 모델이 이미 수년전에 출시되었고, 지난 12월에는 구글의 자회사인 ‘웨이모’에 의해 무인택시 서비스가 최초로 상용화되었다. 차량으로 인한 교통사고의 경우, 일반적으로 운전자에게 책임을 물어 손해배상을 받을 수 있는데, 자율주행자동차의 경우에는 과연 누가 책임을 져야하는지가 명확하지 않다. 차량의 조향이나 속도 등 운행이 소프트웨어에 의해 자율적으로 통제되는데 운전자에게 고의·과실 등을 이유로 책임을 묻는다는 것에 반감이 있을 수 있다. 이 같은 이유로 교통사고 손해배상 책임과 관련된 「자동차손해배상보장법」 이나 「제조물 책임법」 등의 법제개편에 대한 다양한 의견이 나오고 있다. 이에 자율주행자동차의 의의와 전망 및 교통사고 발생 시 민사적 책임을 물을 수 있는 현행법으로서 자동차손해배상보장법과 제조물 책임법을 살펴보고, 해외법제와 기존 연구에 대한 검토를 통해 자율주행자동차로 인한 교통사고의 손해배상책임 관련 법제를 개선할 수 있는 방안을 고찰하였다. 자동차손해배상보장법과 관련, 중요개념인 운행자, 자동차보유자에 대해 알아보고 자율주행자동차 운행과 관련해 운행자(운전자)-자율주행시스템 간 책임귀속, 운행자(운전자)의 타인성 인정여부 등을 검토했다. 제조물책임법에선 자율주행자동차에 설치된 소프트웨어도 제조물로 볼 수 있는지, 제조물 책임법상의 결함기준으로 자율주행자동차에 설치된 소프트웨어의 결함여부를 판단할 경우에는 어떤 기준을 적용할지 등을 찾아보았다. 또한 자율주행자동차로 인한 교통사고 손해배상책임 등과 관련해 우리나라보다 법령정비 면에서 앞서고 있는 미국·독일·일본의 입법사례를 참고해, 자동차손해배상보장법 및 제조물 책임법의 개선사항 등을 검토했다.

Universities and start-ups as well as renowned automakers and IT companies both home and abroad are devoted to research and development efforts for the full-blown commercialization of autonomous vehicles and the advancement of their related technologies. In the US.A, the leading nation of the autonomous vehicles industry, Tesla launched a car model years ago that is capable of partial autonomous driving. Last December, Waymo, a subsidiary of Google, succeeded in the first commercialization of a driverless taxi service. In traffic accidents, it is the general practice to hold the drivers accountable for the compensation for damage. In traffic accidents involving an autonomous vehicle, it is not clear who should be held accountable. In such a case, vehicle operations including steering and speed are controlled autonomously by software. If drivers are held accountable for their intention or negligence in such a case, it may rouse their antipathy. For this reason, there are a variety of opinions raised regarding the reorganization of the legislative system including the Act to Guarantee Compensation for Loss Caused by Automobiles and the Product Liability Act related to liability for damage in traffic accidents. The present study examined the significance and prospect of autonomous vehicles and also the Act to Guarantee Compensation for Loss Caused by Automobiles and the Product Liability Act as the current laws applied to hold one for civil accountability in traffic accidents. It also reviewed overseas legislative systems and previous studies and searched for ways to improve the legislative systems related to liability for damage in traffic accidents involving an autonomous vehicle. After looking into the important concepts of operators and automobile owners related to the Act to Guarantee Compensation for Loss Caused by Automobiles, the investigator reviewed accountability between the operators (drivers) and the autonomous driving system in relation to the operation of an autonomous vehicle and the recognition of otherness of the operators (drivers). Based on the Product Liability Act, the study examined if software installed in an autonomous vehicle could be regarded as a product and which cliteria should be applied to assess defects in software installed in an autonomous vehicle according to the criteria of defects in the Act. In addition, the study consulted the legislative cases of the U.S.A, Germany and Japan, which have advanced ahead of South Korea in legislative arrangement regarding liability for damage in traffic accidents involving an autonomous vehicle, and reviewed what should be improved in the Act to Guarantee Compensation for Loss Caused by Automobiles and the Product Liability Act.
