교육법 체계에서의 『교육기본법』;의 역할과 위상

The Role and the Task of the Fundamentals of Education Act in the Education Law System

｢교육기본법｣은 자유민주주의 교육체제를 지향하는 헌법정신을 구현하여 학교 교육과 사회교육을 포괄하는 교육에 관한 기본적인 사항을 규정하여 모든 교육 관계법의 기본법으로서 1997년 12월 13일에 제정되어 1998년 3월 1일에 시행되었다. 동법은 제1조에서 “ 교육에 관한 국민의 권리･의무 및 국가･지방자치단체의 책임을 정하고 교육제도와 그 운영에 관한 기본적 사항을 규정함”을 목적으로 규정하고 있다. ｢교육기본법｣이 제정된지 20년이 지난 현시점에서 ｢교육기본법｣이 기본법으로서 어떠한 지위와 역할을 하고 있고, 어떠한 위상을 가지고 있는지에 대하여 알아보는 것은 ｢교육기본법｣의 발전에 있는 도움이 될 것으로 판단된다. 이에 본 논문은 ｢교육기본법｣이 관련법률과의 관계에서 어떠한 지위에 있으며, 그 지위에서 ｢교육기본법｣의 역할은 무엇이며, 그 역할을 잘 수행하고 있는지, 또한 ｢교육기본법｣으로서의 역할의 수행여부에 따라 관련법률과의 관계에서 ｢교육기본법｣의 위상을 제시하고자 한다.

By materializing the spirit of the Constitution that aims at the democratic education system and by regulating the basic matters related to the education that include the school education and the social education, as the fundamental act of all of the education-related laws, the Fundamentals of Education Act was enacted on December 31, 1997 and was enforced on March 1, 1998. In Article 1, the said law has been regulating ‘The decision of the rights and the duties of the citizens regarding the education, the decision on the responsibilities of the country and the local governments, and the regulations of the basic matters related to the educational system and the operation’ as the purposes. It is judged that, at the present time point, when it has passed 20 years since the Fundamentals of Education Act was enacted, regarding the Fundamentals of Education Act, as a basic law, finding out what position it has, what role it plays, and what status it has will become of a help to the development of the Fundamentals of Education Act. As such, this thesis intends to find out in what status the Fundamentals of Education Act is in the relationship with the related law, what the role of the Fundamentals of Education Act is in the status, and whether the role has been played well. And, also, it intends to present the status of the Fundamentals of Education Act in the relationship with the related law according to whether or not the role as the Fundamentals of Education Act has been played.
