국가교육위원회 설치와 운영에 관한 법률안의 법적 문제점 검토: ｢국가교육위원회의 설치 및 운영에 관한 법률안｣(조승래의원 대표발의, 2019. 3. 25.)을 중심으로

A Legal Analysis of the Bill of National Commission of Education Act

교육은 국가의 현재에 대한 평가와 장래의 설계이므로 정치적 변화와 독립되어 수립･ 시행되어야 한다. 그러나 우리나라의 교육정책은 교육관료의 무능과 부패, 정치적 이해 득실에 따른 정책결정 등에 의하여 장기적 안목의 수립이 어려웠다. 이러한 현실에서 교육정책의 중장기적 수립과 안정적 추진을 추구하기 위하여 교육부와 정치로부터 독립한국가교육위원회를 합의제 기관으로 설립하고자 하는 방안이 제시되고 현재 법률제정이 진행중이다. 이러한 기관은 교육에 관한 전문성과 독립성을 가진 기관으로서 안정적으로 존속할 수 있어야 한다. 그러나 국회에 제출된 법률제정안의 내용은 이러한 목표를 달성하는 데 매우 부족하다고 평가할 수 있다. 이 기구를 구성하고자 하는 이유는 도외시되고 오로지 이 기구의 구성 자체가 목표가 되어버린 듯하다. 이 글은 국가교육위원회가 어떠한 요건을 갖춘 기관이 되어야 하는지를 살피고 이를 기준으로 국회에 제출된 여러 국가교육위원회 설치 및 운영에 관한 법률안 가운데 특히 조승래의원이 대표발의한 법률안의 내용을 평가하면서 적절한 대안을 모색하고 있다. 국가교육위원회가 그 취지에 맞게 활동할 수 있으려면 전문성과 독립성 그리고 안정성을 확보하여야 하며, 결정한 정책의 집행력이 담보되어야 한다. 이를 위하여 국가교육위원회 소관사무의 범위, 위원 구성의 방법, 교육부와의 관계 설정 등의 문제를 제기하고 이를 위한 대안을 제시하였다.

Since education is an evaluation of the present and future design, it should be established and implemented independently of the political change. However, it was difficult to establish a long-term view of education policy in Korea due to the incompetence and corruption of education bureaucracy and political decisions on the education. In this situation, in order to pursue long-term establishment and stable promotion of education policy, a plan is proposed to establish a National Commission of Education independent of the Ministry of Education and Politics and legislation is in progress. This institution must survive with expertise and independence. However, the content of the bill submitted to the National Assembly may be considered insufficient to achieve this goal. The reason for the organization is neglected and only the organization itself seems to be the goal. This paper examines what requirements the National Commission of Education should be, and then evaluates the content of the bill on the establishment and operation of the National Commission of Education, and seeks appropriate alternatives.
