유럽연합의 인공지능 관련 입법 동향을 통해 본 시사점

인공지능과 로봇이 경제·사회적으로 영향력을 확대해가면서 기대 못지않게 우려의 목소리가 높아지고 있다. 인공지능의 발전과 이용에 따른 문제점을 다루기 위해 입법부와 행정부가 입법과 규제에 나서야 한다는 요구도 커지고 있다. 지나 친 규제가 기술 혁신을 가로막을 것이란 우려가 있지만, 적절한 규제는 이용자와 공공의 안전을 보장하고, 법적 확실성은 기술 발전에 긍정적으로 작용할 수 있다. 이 글은 인공지능 기술 및 활용과 관련해 규제와 입법의 방향을 어떻게 설정 할 것인지 살펴보았다. 이를 위해 유럽연합이 인공지능기술의 발전과 관련해 어떤 원칙을 세웠고, 어떤 과정을 거쳐 인공지능 관련 가이드라인을 마련했는지, 그 구체적인 내용은 어떠한지, 규제의 방향은 어떠한지 등을 분석했다. 유럽연합은 로봇과 인공지능에 관한 사회적 의제 설정이나 법적·윤리적 쟁점 연구에서 선도적인 입장에 서있기에 인공지능에 관한 논의를 본격적으로 시작하고 있는 한 국에 좋은 본보기가 될 것이다. 이어서 한국 정부 주도로 마련된 윤리가이드라인, 국회에 제출된 법률안 등의 세부적인 내용을 검토했다. 이를 통해 인공지능 기술의 개발과 활용을 어떤 원칙에 따라 어떻게 규제해야 할 것인지 시사점을 도출했다.

As the influences of Artificial Intelligence (AI) and robotics are growing, the voices of concerns regarding AI and robotics are getting louder. The demands that the possible problems and adverse-effects caused by the development and application of AI and robotics should be addressed by the legislature and the administrative are getting strong support. Some argues that overly rigid regulations will hinder the innovation. However, appropriate regulations will ensure the public safety and security of users. Legal certainty can also have positive effects on the development of technology. This paper aims to examine how to set forth regulations regarding technology application. It compares the regulatory framework concerning AI and robotics between the European Union and Korea. The EU is leading in the regulatory field of AI and robotics. It carried out wide-range of researches and consultations and set forth the direction of regulatory framework on AI. The EU puts emphasis on the human-centric AI and establishing principles to prevent harmful results caused by technology. Korean government has set ethical guidelines, and some legislators have proposed several bills regarding AI and robotics. However, the measures appear insufficient. By exploring the case of the EU, this study tries to find the meaning in establishing the regulatory framework of AI in Korea.
