일본의 성년연령 개정과 우리 민법에의 시사점

Amendment of the Age of Adulthood in Japan and Implications for our Civil Code

성년연령은 그 당사자의 행위능력뿐만 아니라 책임능력, 유언능력, 혼인적령, 입양능력, 양육, 친권 등 민사상의 많은 제도와 연관된다. 또한, 근로기준법, 아동복지법, 공직선거법 등 연령을 기준으로 하는 다양한 개별특별법에 직·간접적 영향을 끼치게 된다. 본 연구에서는, 일본이 2018년에 성년연령을 기존의 20세에서 18세로 낮추는 개정을 하면서 직면하였던 다양한 쟁점들과 그 해결책을 모색하는 과정을 개관하면서, 이를 기초로 우리나라가 성년연령을 18세로 낮춘다면, 무엇이 문제가 되는지, 그리고 우리의 연령기준은 어떠한지 등을 살펴보았다. 특히, 성년연령이 18세로 하향조정되면, 책임능력, 혼인적령 등도 불가피하게 영향을 받게 되는바, 이를 어떻게 해결해야 하는지에 대해 살펴보았다. 입법정책의 문제이긴 하지만, 저자는 우리의 성년연령도 UN 아동권리협약의 반영, 세계화를 향한 입법, 저출산·고령화 시대와 북한과의 통일 대비라는 점 등에서 18세로 하향조정할 필요가 있다는 결론에 이르렀다. 다만, 성년연령이 18세로 하향조정될 경우에 발생가능한 부작용을 해소하기 위해 청소년의 자립확보, 청소년소비자보호 등의 대책이 마련될 필요가 있다. 이에 대해서는 일본의 입법자들이 개정과정에서 논의한 내용들이 적절한 선례가 될 것으로 생각된다. 이와 더불어, 용어와 연령기준 사용에 있어서 통일된 개념 내지 체계화가 필요하다고 본다. 또한 연령계산에 있어서는 세계화의 관점에서, 그리고 국민의 상식에 부합하는 통일된 기준의 마련이 시급하다고 본다.

In 2018, Japan revised its adult age to 18 years. In the process of revision, i) looking at the effect of the adult age on other laws(① the issue of whether to keep the laws adopting age standards such as the Juvenile Protection Act, ② the issue of considering the purpose of individual laws, etc.), ii) prepare to eliminate side effects (① Measures to prevent consumer damage from spreading, ② Measures to support the self-reliance of adolescents, ③ To solve problems in student guidance in high school education, ④ To publicize thoroughly to the general public etc), ⅲ) in order to minimize the negative effects, the method of implementation and worries about the implementation period were preceded. Since the adult age of Korea is based on the age of 19, it needs to be lowered to 18 years in line with the global trend. However, efforts should be made to minimize the negative effects of downward adjustment of adult age, and we should refer to the revision process of Japan as a precedent that we can utilize. In addition, it is necessary to correct the various age standards and terminology of our law and the problem of age calculation from the viewpoint of unification of the legal system.
