중국의 안례지도제도에 관한 연구

An Overview of Guiding Case system in People’s Republic of China

중화인민공화국 최고인민법원은 2010년 심판(審判) 경험을 총괄하고, 법률 적용을 통일하며, 심판의 질을 제고하고, 사법공정을 수호하기 위하여 ‘안례지도(案例指導) 제도’를 도입하였고, 2018년 10월 최고인민법원의 법률응용에 대한 해석권과 지도안례(指導案例) 공포권이《인민법원조직법》에 명시되었다. 본 연구는 중국에서 분쟁해결의 기준 중 하나로서 제시되고 있는 안례지도제도의 형성배경, 선정절차, 영향력과 효력을 연구하여 우리나라에 소개함으로써 우리에게 주는 시사점을 모색하였다. 특히 지도안례의 영향력을 실증하기 위해 필자 나름의 방식으로 지도안례를 범주화하고 관련 통계자료를 직접 산출하였으며, 본 논문을 통해 안례지도제도가 한중 간 분쟁해결의 기준으로서 필수적으로 고려될 수 있도록 실무적으로 유용한 연구결과를 제시하고자 하였다. 중국의 안례지도제도는 재판에 대한 질적 통제를 시도하고 있다는 점에서 우리나라의 사법실무에서도 영감을 얻을 만한 점이 있는지 살펴볼 만하다. 무엇보다도 유사한 사건에 있어서 판결의 결과가 서로 달라지는 경우 국민은 판결의 결과가 더욱 공평하지 못하다고 받아들이게 되는데, 중국의 안례지도제도는 사법부에 대한 신뢰 구축방법의 하나로서 유사한 사건에 대한 다른 판결의 문제를 해소하기 위하여 도입되었다. 필자는 향후에도 최고인민법원에서 공포하는 지도안례에 대한 추적을 계속하여 지도안례의 실질적 구속력을 탐구하고, 한중교류 및 우리 사법제도에 있어서 안례지도제도가 가지는 의의를 지속적으로 발굴해나가고자 한다.

The Supreme People s Court of the People s Republic of China introduced the Case Guidance System in 2010 to oversee the judging experience, to unify the application of laws, to improve the quality of judgment and to protect the judicial process. In October 2018, the Supreme People s Court’s right to publicize the guiding case is introduced in the People s Court Organization Law. The purpose of this article is to investigate the formation background, selection process, influence and effect of the case guidance system, which is suggested as one of the standard of conflict resolution in China. In particular, in order to demonstrate the influence of guiding cases, I categorized guiding cases in my own way and produced relevant statistics myself. Through this article, I aimed to present practical research results that can be used to consider the case guidance system as a basis for resolving disputes between Korea and China. It is worth noting that the case guidance system is trying to control the quality of the trial. First of all, if the results of a ruling are different from each other between similar cases, the people will accept it more unfair. The case guidance system introduced to solve this problem as one of methods of building confidence in the judiciary. I will continue to follow up on upcoming guiding cases promulgated by the Supreme People s Court in the future to explore the practical binding power of guiding cases, and discover the significance of the case guidance system in Korea-China relations and our judicial system.
