Purpose - The purpose of this study was to review Korea’s decision on the import ban on Japanese fisheries products and to discuss the direction of how to lead trade negotiations with Japan while maintaining the current import restrictions on Japanese food. Design/methodology/approach - This study summed up legal reviews of the panel’s decision on Korea’s earlier ban on imports of Japanese fishery products. At the same time, it aims to differentiate itself from previous studies by reviewing the details of the appeal body’s final ruling made in April this year and by analyzing the impact of such a ruling on future trade negotiations between Korea and Japan. Findings - In April 2019, the appeals body ruled that Japan’s environmental situation, which could affect food contamination, should be taken into account when assessing the situation in Japan, not just the radiation level of the food. Research implications or Originality - As a discussion on the direction of how to lead trade negotiations with Japan while maintaining the current import restrictions on Japanese food products, we will gather scientific evidence and suggest ways to actively utilize regional trade agreements.
