공기업에는 국회의원이나 관련 정부나 지방자치단체로부터의 인사청탁이 잦다. 이들이 공기업의 기관장에 대한 인사권자이거나 이들 기관의 감시를 받아야 하므로 공기업의 기관장은 이들의 요구를 거절하기 어렵기 때문이다. 그만큼 자율적이고 책임적 경영이 보장되기보다는 외부의 청탁에 취약한 면을 가지고 있다. 또한 공기업이 독점적 지위를 가지는 경우가 많아 경쟁으로부터 자유로운 경우도 많기 때문이다. 직원 가운데 많은 사람들이 청탁을 통하여 취업한 경우 그 조직 안에서 공정한 인사를 기대하기가 더욱 어려워진다. 이러한 과정을 통하여 공기업은 사유화된다. 강원랜드는 내국인 출입이 가능한 카지노와 호텔 등을 경영하는 공기업이다. 몇 년 전 이 기업에 대해 국회의원 등이 인사청탁을 한 사례가 최근에 드러났다. 이는 공기업의 인사에서 중시하여야 할 공정성, 개방성과 객관성을 훼손하는 것이라 평가할 수 있으며, 형법과 부정청탁금지법에 위반되는 문제를 안고 있다. 이 글은 강원랜드 사건과 관련하여 공기업의 인사원칙과 공정성 등을 훼손한 인사의 문제점, 그러한 행위가 어떠한 법적 평가를 받게 되는지 등을 검토하고 이에 대한 해결방안을 모색하고자 하였다.

Public corporations are often asked by the lawmakers and related governments for the recruitment. It is difficult for the heads of public corporations to refuse their demands because they have the power of appoinment of the head of the corporationes or should be audited by them. Rather than guaranteeing the autonomous and responsible management, it is vulnerable to outside solicitation. In addition, public corporations often have exclusive positions and are free from competition. If many of the employees are hired through illegal solicitation, it becomes more difficult to expect a fair recruitment within the organization. Through this process, the public entity is privatized. Kangwon Land is a public corporation that operates casino and hotels that allow access to Koreans. It has recently been revealed that the members of the National Assembly and government officials have requested personnel appointments for this corporation. This can be assessed as a violation of fairness, openness and objectivity principles that should be adhered to in the personnel recruitment of public corporation, and it has problems that violate the Criminal Law and the Anti-Corruption Act. This article reviewed the recruitment problems that undermined the personnel principles and fairness of public corporations in connection with the Kangwon Land case, and tried to seek the solutions.
