A Study on the Issues and Improvement of FTA Rules Origin for Fisheries

With the advent of global trend for expansion of FTA, there is a growing need to reflect on how to protect less competitive sectors such as agriculture and fisheries and the method of protection, as tariffs as a measure of protecting domestic market is ever decreasing. This study will examine the rules of origin for FTA on fisheries to study countermeasures and improvements in countering the spread of FTA for protection of domestic fisheries market and for the use in developing international trade policies. It will also compare and contrast the main points of FTA among major trading partners in fisheries industry of China, Vietnam and USA. Unlike industrial products, fish products are much more prone to be subjected to the rules of wholly obtained goods and the definition of territory and its scope need further investigation in their interpretations. Furthermore, we will examine how the inherent characteristics of fish products affect the determination and decisions of product of origin. Lastly, the study will examine the application and problems of change in tariff classification criteria in applying produce specific rules, the relationship between processing/manufacture vs. sufficient processing principle in fisheries, and we aim to analyze and raise issues in the limits and the improvements of applying value added rules in fisheries market.
