경찰공무원의 재해보상제도 개선방안에 관한 연구

A Study on the Improvement of Disaster Compensation System for Police Officials

국민의 안전을 위한 직무를 수행하는 과정에서 발생하는 경찰공무원의 공상과 순직에 대한 지원은 사회의 안전을 위한 필수적인 지출이라는 인식이 필요하며, 이를 위해서 운영 중인 재해보상제도에 대한 고찰은 경찰공무원 뿐만 아니라 국민의 안전을 위해서도 필요하다. 이에 이 연구에서는 현재 운영 중인 경찰공무원에 대한 재해보상제도가 지니는 제도적인 한계점과 지원과정에서 발생하는 문제점을 지적하고 이에 대한 개선방안을 제시하였다. 먼저 현재 3년으로 제한된 공무상 휴직기간에 대한 합리적 연장을 통해 직업을 잃게 되는 경찰공무원의 숫자를 줄이기 위한 입법적 노력을 할 것과 해외의 사례를 바탕으로 부상을 입은 경찰공무원에 대해 복직 또는 재임용을 통해 업무에 종사할 수 있는 기회를 제공할 것을 주장하였다. 또한 소방에서 추진 중인 공상추정제도의 도입과 관련하여 경찰청 차원의 적극적인 추진노력이 필요함을 주장하였으며, 특별위로금 제도의 지급범위의 명확성 확보와 지급방식에 대한 입법적인 대안을 제시하였다. 또한 경찰청 차원의 재해보상 관련 제도운영의 문제점 개선을 위해 경찰공무원의 재해 및 이와 관련된 데이터의 수집, 분석, 활용에 대한 제언을 하였으며, 최근 강조되는 재해예방을 위한 노력과 경찰청 차원의 지원제도에 대한 적극적인 홍보를 주장하였다.

It is necessary to recognize that the support for the died and injured police officers in the course of performing their duties for the safety of the people are essential expenditures for the safety of society. For this purpose consideration of the disaster compensation system in operation is necessary for the safety of the public as well as police officers. This study points out the institutional limitations and problems of the current disaster compensation system for police officers, and suggests ways to improve them. First, legislative efforts will be made to reduce the number of police officers who lose their jobs through a reasonable extension of the current three-year period of public leave of absence. And Based on the overseas case, injured police officers should be given the opportunity to work in reinstatement or re-appointment. In addition, active efforts should be made by the National Police Agency in relation to the introduction of the disaster estimation system, which is being promoted by National Fire Agency. And it proposed legislative alternatives to secure clarity of payment scope and payment method of special compensation system. Also, it is necessary to collect and analyze disasters and related data of police officers in order to improve the problems in the operation of the system related to disaster compensation at the National Police Agency. And efforts to prevent disasters recently highlighted and active publicity about the support system at the National Police Agency are necessary.
