2005년 2월 교토의정서 발효에 따라 이루어진 2015년 12월 파리기후변화협약을 필두로 환경보호 및 녹색성장에 대한 국제사회의 노력이 점차 구체화되고 있는 상황이다. 그러나 우리나라의 현실은, 제조업 특히 석유화학과 전기 소비량이 많은 철강, 자동차 산업이 주류인 산업구조적인 측면을 고려할 때, 여전히 우선적으로 고려되어야 하는 문제는 에너지의 안정적 공급이다. 이러한 국제사회의 흐름과 우리나라의 산업경제 기반이 처한 현실을 고려할 때에너지의 효율성 확대도 하나의 새로운 중요한 제도적 축이 되어야 한다. 그런 측면에서 신재생에너지에 대한 연구개발과 기존의 발전된 원자력기술(보다 발전된 원전 안전기술) 등에 대한 국가적 지원이 지속적으로 골고루 이루어져야 한다. 이와 맞물려, 지금까지 우리나라의 에너지 관련 법제는 급속한 경제성장과 함께 에너지원별로 개별적 산발적으로 발전해 왔던 까닭에 거시적이고 종합적인 에너지 정책을 지원하기 위한 입법이 늦은 감이 있다. 또 그 입법 역시 발생한 문제점을 해결하기 위한 개별 대책 위주로 제정된 문제가 있다. 이제 우리나 라는 국가차원의 에너지 정책이나 에너지 법제를 재편하는 작업이 필요하다. 특히, 에너지원 별로 각각 발전시켜 왔던 에너지 관련 법제와 서로 분리되어 있는 에너지기본법의 통합작업 등이 요구된다. 그와 동시에 개별 법률간 중첩된 에너지 관련 개념의 정리, 여러 갈래로 분산되어 있는 에너지 관련 위원회의 구성 및 체계를 효율적으로 통합하고 재편하는 등 관련 법제도 전반적인 재정립이 필요하다.

In addition, the legislation also has a problem set up to address individual problems. Now, Korea is a country that has undergone certain stage of industrial growth, and it is necessary to reorganize energy policy and energy legislation at the national level. In particular, it is required to integrate the energy-related legislation, which has been developed for each energy source,and the Energy Basic Law, which seem to be separated from each other. At the same time, it is necessary to reorganize the energy-related concepts among individual laws, to effectively reorganize and organize the composition and system of energy-related committees that are scattered and distributed in various ways.
