경비업법의 문제점 및 개정방향

Problem of Security Services Industry Act and Its Revision Direction

위험사회로 정의되고 있는 현대 사회는 경제가 성장하고 사회가 발전할수록 사회 양극화와 세대적 갈등은 점점 증가하고 자살률 증가와 같은 다양한 사회 위기 현상이 초래되고 있다. 한국 사회 또한 1970년대에 들어서면서 급속한 도시화 및 산업화로 인하여 사회 곳곳에서 많은 변화를 맞이하였다. 이에 1976년 12월 31일 법률 제 2946호에 의거 ‘용역경비업법’이 제정되면서 경찰과 함께 치안수요의 한 부분을 담당할 수 있는 법적, 제도적 큰 기틀을 마련하였다. 하지만, 이러한 질적·양적 성장에도 불구하고 여러 가지 문제점이 드러나고 있다. 시대의 흐름에 따라 지속적으로 경비업법이 개정됨에도 불구하고, 적시에 개정되지 못하거나 사회적 요구 수준에 미치지 못하는 등의 문제점이 발생하고 있다. 경비업법이 사회적 요구 수준에 맞게 개정되거나, 민간경비산업의 변화에 따라서도 개정되어야 할 것이다. 특히, 경비업법 제18조 제2항은 직업의 자유 침해에 해당 할 수 있다. 동법 제18조 제6항 또한 직업의 자유 침해 및 평등권 침해에 해당 할 수 있다. 위 조항은 급 변화하는 사회의 요구와 맞지 않을 뿐만 아니라, 민간경비 산업의 발전을 저해하는 요소로서 개정의 필요성이 요구된다고 할 수 있다.

In modern society, which is defined as a dangerous society, social polarization and social conflicts are increasing and social crises such as increased suicide rate are increasing as the economy grows and society develops. Korean society also entered the 1970s and has undergone many changes in society due to rapid urbanization and industrialization. As a result, the Security Industry Act was enacted on Dec. 31, 1976, Law 2946, and together with police provided a legal and institutional framework was set up for dealing with a part of police demand. However, despite such qualitative and quantitative growth, various problems are being revealed. In spite of the revision of the Security Industry Law, there are problems such as not being able to be revised in a timely manner or falling short of the social demand level. The security industry law should be revised to meet the social demand level or be revised according to changes in the private security industry. In particular, Article 18 (2) of the Security Industry Act may be a violation of occupational freedom. The Article 18 (6) may also be a violation of the freedom of occupation and the infringement of equal rights. The above clause not only does not meet the demands of rapidly changing society, but it also calls for the necessity of revision as a factor impeding the development of private security industry.
