미국 탐정제도의 고찰과 시사점

A Study on U.S Private investigate System and Implications

탐정에 대한 오랜역사를 가지고 있으며 탐정제도를 안정적으로 운영하고 있는 미국 탐정제도를 고찰하고 한국 탐정제도 도입에 대한 시사점을 제공하고자 하였다. 미국의 탐정제도 고찰을 통한 시사점은 다음과 같다. 첫째, 탐정업은 전문직으로서 최소한의 근무경력, 학력 및 훈련이 필요하다. 둘째, 면허 취득요건으로 관련 시험(법학, 실무)이 필요하다. 셋째, 고객의 보호 및 직원의 안전을 위하여 보증채권 및 보증금제도가 필요하다. 이러한 시사점은 미국은 탐정제도가 비교적 포괄적이며 최소한의 규제방식으로 운영되고 있음을 고려할 때 한국의 탐정제도 도입 시 탐정제도의 안정적인 정착과 고객의 사생활 보호와 안전을 확보하기 위해서도 최소한의 제도적 장치는 마련되어야 한다.

The purpose of this study is to investigate the US Private investigate system which has a long history of detectives and operates the detective system in various ways in a stable manner, and to provide implications for the introduction of the Korean detective system. The implications of the US investigative system are as follows. First, the professions are professions that require a minimum of work experience, education and training. Second, related examination (law, practice) is required as license acquisition requirement. Third, the guarantee bond and deposit system should be introduced for the protection of the customers and the safety of the employees. This suggests that the US has a minimum system of institutional arrangements in order to ensure the stable establishment of the detective system and the protection of privacy and security of customers when introducing the detective system in Korea, considering that the detective system is relatively comprehensive and operates in a minimal regulatory system.
