신변보호사 자격제도 민간경비 활용 현실화에 관한 연구

A Study on utilizing the Private Security for Qualification System in Private Security Guard Security Industry Act: Focusing on the Scene of the Group Civil Petition

신변보호사는 의미 그대로 민간경호ㆍ경비 실무 전문 자격자 배출을 통해 민간경비 산업발전에 기여하고자 만들어진 자격이다. 하지만 『경비업법」에 따른 자격요건에 해당되지 않기 때문에 자격취득자에게 실효되지 못하고 있는 것이 현실이다. 소관기관이 경비업을 관장하는 경찰청임에도 불구하고 실무에서 자격의 인정이나 취업 우선권조차 받을 수 없다. 최초 자격을 공인화 하는 과정에서 시행과 동시에 입법까지도 고려하였으면 하는 아쉬움을 남기고 있다. 따라서 이 연구는 신변보호사의 민간경비 활용을 위해 『경비업법』에 법제화 방안 등 정책적 제언을 논의하고자 하였다. 신변보호사를 『경비업법』에서 정한 경비원 자격으로 법제화하여야 하여 신변보호 및 집단민원현장에 적극 활용하도록 하는 방안을 모색한다. 또한, 이 외에도 자격제도 시행에 앞서 자격의 결격사유 고지, 응시료 부담 최소화, 적극적인 홍보로 민간인이 쉽게 접할 수 있도록 하는 등 저변확대를 위한 노력이 필요하다. 이상의 문제점들을 보완하여 정상화된 신변보호사의 실무활동을 기대한다.

A Private Security Guard is a qualification to contribute to the advancement of private security industry by choosing a talented person for private guard·security working. However, It has not been fulfilled as they don t have a qualification requirements by 『Security Industry Act』. Although Police Department is in charge of it, they couldn t also have a qualification and priority to get a job. First conducting a business and legislation should be considered in the process of approval of qualification. Therefore, this study is to discuss the legislation and suggestions on 『Security Industry Act』 to utilize the private security of private security guard. It is necessary that the private security guard should be legislated as a guard in 『Security Industry Act』 and utilized it as personal protection on the scene of group civil petition. In addition, It requires an individual to try without difficulty by positive promoting the reasons for disqualification, reducing costs for the test.
