미국과 일본의 순직·공상경찰공무원 보상제도에 관한 연구

Study on the Compensation System for the Sacrificed Police Officers in USA and Japan

국가와 국민의 재산을 보호하고 공공질서를 유지하는 것은 경찰공무원의 기본임무이다. 이처럼 국가와 국민의 재산을 보호하다가 안타깝게 순직자나 혹은 공상자가 된 경찰공무원에게 국가와 국민은 그들을 선양하는 일에 조금이라도 게을리 해서는 안된다. 동시에 순직자들의 유가족들에게 보훈법에 따라 충분하게 보상하고 보훈연금을 지급하여 생계를 유지할 수 있도록 해주는 일을 국가뿐 아니라 모든 국민들이 참여하는 적극적인 지원문화가 지속적으로 확산되는 일이 중요하다고 본다. 본 연구에서는 특별히 순직·직공상경찰공무원에 대한 지원제도가 가장 잘 체계화 되어 운영 중인 미국과 일본의 순직·공상경찰공무원 보상제도의 실태를 분석하고 우리나라 순직·공상경찰 지원제도에 주는 시사점을 찾는데 목적을 두었다. 미국의 경우는 도네이션 문화가 발달하였으며 연방정부, 주정부, 시정부, 경찰노조 및 시민중심의 비영리경찰후원단체(COPS와 HEROES)로 부터 지원활동이 매우 강하다. 일본의 경우는 순직·공상경찰에 대한 법제도적 차원에서 순직자, 장애자, 부상자 지원제도가 잘 갖추어져 있으며 이와는 별도로 총리, 지방자치단체장, 시장 등으로부터 적지 않은 위로금이 지급되고 있고 비영리경찰후원단체들의 유가족지원제도가 활발하다. 한국의 경우는 순직·공상경찰의 경우 법에 따라 보훈제도상의 혜택을 받는데 집중되어 있으며 동시에 경찰청은 기업과 연계해 유가족 자녀의 장학금을 연결해 주는 노력을 하고 있는 정도이다. 따라서 유가족들은 「국가보훈법」에 따라 충분하지 않은 보상금을 받는 정도에 그치고 있고 어려움에 시달리고 있다. 따라서 본 논문에서는 미국에서처럼 우리나라에서도 순직·공상경찰 후원을 위해 비영리민간후원단체가 발족되도록 하고 유가족을 위한 후원문화가 시급하다고 제언하였다.

It is a basic duty of police officers to protect the wealth of country and citizens and to maintain public order. In this way, country and citizens should not be idle in exalting police officers who died or was injured on duty. At the same time, country should help families of deceased to sustain their living by fully compensating and providing veteran pension according to veteran laws. It is important that active support culture continuously spreads not just by the government but by all people. In this research, compensation systems for deceased and injured police officers in America and Japan, where compensation systems for deceased and injured police officers are most systematically operated, were analyzed. The objectives were to find implications for compensation systems for deceased and injured police officers in South Korea. In the United States, donation culture is prevalent, and there is strong support from federal government, state government, city government, police union and citizen-centered nonprofit police support groups (COPS and HEROES). In Japan, legal aspects of deceased and injured policeman are well prepared in terms of support systems for deceased, disabled and injured. Separately, considerable amount of compensation is given from prime minister, local government leaders and mayor and there is active family support systems from nonprofit police support groups. In South Korea, the laws regarding deceased and injured policeman are focused on benefits of compensation system, and at the same time the national police agency tries to provide scholarships for children of deceased by connection with companies. Therefore, families of deceased are limited to receiving inefficient compensations according to compensation law, and as a result suffer from hardship. Therefore in this paper, it is suggested that like the United States, nonprofit civil support groups for supporting deceased and injured policeman should be launched in South Korea, and that support culture for families of deceased are urgently needed.
