A Study on the Hierarchical Model of Good Faith Principle

신의성실의 원칙의 계층적 구조모델에 관한 연구

연구목적: 신의성실의 원칙의 중요성에도 불구하고 그 개념이 도덕적 가치라는 관념적인 부분에 그 기반을 두고 있어 개념과 적용범위 등이 모호하다는 한계가 있고 이러한 한계는 여러 연구에서도 공통적으로 언급하고 있는 부분이다. 하지만 대부분의 연구들이 이러한 한계를 언급하는 정도에 그치며 신의성실 원칙의 유형화를 크게 확장하지 못하고 있다. 따라서 본 연구는 신의성실의 원칙의 유형화를 위해 계층적 구조 모델을 도출하여 신의성실 원칙의 유형화를 확산함으로써 신의성실 원칙의 명확화를 제고하는 것을 그 연구목적으로 한다. 논문구성/논리: 본 논문을 총 5개장으로 구성되어 있으며 제1장은 서론으로서 연구의 배경과 연구목적을 기술하고 있으며 제2장은 선행연구를 분석함으로써 기존연구와의 차별성을 도모하고 있다. 제3장은 신의성실에 관한 이론적 고찰을 수행하고 있는 이론 적 근거와 그 문제점을 도출하고 있다. 제4장은 신의성실 원칙의 계층적 구조모델을 도출하고 있다. 제5장은 결론을 내리고 있다. 결과: 기존의 선행연구를 통하여 신의성실의 원칙의 이론적 토대를 확인하기 위해 다양한 이론과 그 한계를 검토하여 신의성실 원칙의 계층적 구조모델을 도출하였고 이러한 계층적 구조모형에 근거하여 신의성실의 원칙과 하위원칙인 실효의 원칙, 모순행위금지의 원칙 그리고 사정변경의 원칙에 대한 법 명제를 도출하였다. 독창성/가치: 본 논문은 기존에 연구되지 않은 신의성실의 유형화를 위한 계층적 구조모델을 개발하고 그러한 모델에 입각하여 신의성실의 원칙과 하위원칙인 실효의 원칙, 모순행위금지의 원칙 그리고 사정변경의 원칙에 대한 법 명제를 도출하여 그러한 법 명제에 입각한 판단을 도출할 수 있는 이론적 토대를 도출하고 있다는 점에서 독창성이 있다고 볼 수 있다.

Purpose: Despite the importance of the principle of good faith, it suffers from certain limitations, such as the ambiguity of the concept and the application of good faith. The concept is based on the notions of moral value, and these limitations are commonly referred to in many studies. However, most studies have only mentioned these limitations and have not significantly expanded the categorization of the aforementioned principle. Therefore, this study aims to enhance the clarity of the principle of good faith by building a hierarchical structural model for the classification and propagation of the principle. Composition/Logic: Section 1 describes the background and purpose of this study and section 2 seeks to differentiate this study through a literature review. Section 3 outlines the rationale of good faith and its problems by conducting a theoretical examination of good faith. Section 4 presents a hierarchical structural model of the principle of good faith. Section 5 provides concluding remarks. Findings: To confirm the theoretical foundation of the principle of good faith, various theories and their limitations were reviewed to derive a hierarchical model of the principle. On the basis of this model, the legal propositions of the principles of being lapse, estoppel, and change of circumstances were derived. Originality/Value: This study is novel in that it first develops a hierarchical model for the categorization of good faith and draws up the legal propositions of the principles of good faith, in particular, the principles of being lapse, estoppel, and change of circumstances.
