주민주권에 입각한 주민자치제도설계를 위한 소고

A Study on Institution Desigsn of Residents’s Autonomy for Mature Democracy and Residents’s Sovereignty

한국의 주민자치제도가 단편적인 관점으로 운영되면서, 주민자치의 본질인 주권재민이나 민주주의, 그리고 지방자치라고 하는 다각적 관점에서 성숙을 이룰 수 있는 제도설계에서 벗어나고 있다고 보여진다. 본 고에서는 최근 논의되고 있는 지방자치법의 개정이나 지방자치단체에서 시도되고 있는 OO형 주민자치 등의 시도에 자칫 놓치기 쉬운 제도설계의 기본을 다시 한번 상기시키면서, 한국의 주민자치가 제대로된 지방자치와 성숙한 민주주의에 기여할 수 있는 제도가 되기 위해서는 어떠해야 할 것인가를 분석하였다. 특히 헌법의 기본정신이라고 할 수 있는 주권재민과 민주공화정의 가치와 철학을 반영한 제도설계가 되는 방향으로 길을 잡을 수 있도록 제언을 해 보았다.

The residents’s autonomy institution of Korea is on the irregular way because of only administrative respective. Therefore, it is out of regular way which means mature democracy, essential local autonomy and Sovereignty rested with the people. This study call attention on the residents’s sovereignty, mature democracy and essential local autonomy. In sequence, the problem on amendment of Local Autonomy Act and the limit of residents’s autonomy of Seoul Metropolitan Government is analyzed. The study’s policy proposal rested on the analysis of Chapter 3. The first direction of institution design for mature democracy and essential local autonomy is to introduce the autonomy system for neighborhood district. The second one is to constitute the government which based on general assembly and autonomy finance. The third one is to form bottom-up autonomy hierarchy. Finally, the challenge to Korea’s local autonomy institution is the reform to change autonomy paradigm from self-governing body to residents’s autonomy.
