지적측량시장 환경변화에 따른 공익서비스의무 도입 방안 연구

A Study on the Introduction of Public Service Obligation in Changing Cadastral Surveying Market Environment

본 연구에는 지적측량시장의 환경 변화에 따른 지적측량서비스의 형평성에 관한 한계성을 도출하고, 공공재로서 지적측량서비스의 지속적인 제공을 위한 공익서비스의무 제도의 도입 방안을 모색 제시하고자 하였다. 연구성과는 다음과 같다. 먼저, 지적측량시장 환경변화와 이에 따른 지적측량서비스의 한계를 검토하였다. 검토된 한계성에 기초해 공익서비스의무 도입 방안을 제시하였다. 사전 공익서비스의무 도입을 위한 기준 총족여부를 검토한 결과, 지적측량서비스는 공익서비스의무 제도를 적용한 이후에 준수해야 할 대부분의 기준을 충족하고 있는 것으로 나타났다. 제도 도입을 위한 구체적 방안으로서 보상 기준 및 방식의 설정은 측량수수료 감면 또는 실비보상 차원에서 발생하는 손실을 원인제공자인 정부가 확보하고, 공익서비스의무를 시행하는 지적측량수행자와 계약을 통해 정부의 재정에서 직접 지원해주는 방식이 가장 적합한 방식으로 제안하였다. 재원조달 방안은 지적측량수수료 체제 개편을 통해 별도의 재원을 확보하는 방안을 제시하였다. 공익서비스의무 도입을 위한 법률 개정안은 「공간정보의 구축 및 관리 등에 관한 법률」에 부담 및 보상 규정을 신설하는 방안을 제시하였다.

This study aims at identifying the limitation in the fairness of the cadastral survey service due to a change in the cadastral surveying market environment and exploring a way to introduce a public service obligation (PSO) system to provide the survey service as public goods continuously. Study results are as follows. First, the limit in the cadastral survey service is reviewed to suggest how to introduce the PSO system. Based on the review results, measures on how to introduce the PSO are proposed. The study examined whether the cadastral survey service fulfills a necessary standard applied after introducing the PSO. It turned out the survey service satisfies most of the standard. As a concrete measure on the compensation standard, it is suggested that the government, a contributor, shall secure a budget to make up for a loss occurred by exemption on a survey fee or an actual cost compensation. Concerning the method, it is proposed that giving financial aid directly from the government budget is most appropriate by signing a contract with a cadastral surveyor implementing the PSO. As a way to supply finance, it is recommended to secure a separate resource by reshuffling the cadastral survey fee system. Lastly, as a revised bill required in introducing the PSO, the establishment of a liability and indemnification regulation on ACT ON THE ESTABLISHMENT, MANAGEMENT, ETC. OF SPATIAL DATA is suggested.
