청소년의 노동인권에 대한 인식조사와 지방정부에의 정책함의

A Survey on Awareness of Labor Rights of Youth and Policy Implications for Local Government

본 연구는 만 16세에서 19세까지의 청소년들을 대상으로 고용환경 및 노동환경에 대한 실태를 조사하여 그 결과를 바탕으로 지방정부 차원의 고용 및 노동환경 개선과 청소년 노동인권 실현을 위한 정책방안을 제시하고자 하였다. 연구 결과 청소년에 대한 노동인권교육이 부족한 상황에서 많은 청소년들이 노동인권에 대한 정보가 부족하다고 생각하고 있음이 조사되었다. 사실 노동에 대한 이해와 경험을 통해 성인이 되기 위한 준비를 충실히 할 수 있기 때문에 청소년기에 노동의 의미를 익히고 실제 노동이 이루어지는 현장을 경험해보는 것은 매우 바람직한 것이다. 그러나 청소년은 사회적인 경험 부족 등 나이가 어린 관계로 고용계약상 ‘을’의 위치에 놓이는 등 상대적 약자의 위치에 놓이게 되며, 노동 현장에서 권리를 침해당할 가능성이 성인에 비해 매우 큰 편이다. 따라서 건강하고 건전한 청소년의 성장을 지원하고 보호해야 하며, 이러한 측면에서 청소년 노동인권정책의 기틀을 마련하는 지방정부 차원의 노력과 정책적 지원이 필요하다. 결론적으로 청소년 노동인권도 결국은 인권의 측면에서 접근해야 하므로 자치와 분권의 시대에 바람직한 인권 거버넌스(human rights governance)를 위해 지방정부 차원의 지속적인 노력과 성과 창출이 필요하다고 할 것이다.

This study was intended to investigate the status of employment and labor conditions among teenagers aged 16 to 19 and present policy measures for improving employment and labor conditions at the local government level and realizing youth labor rights based on the results. Studies have shown that many teens believe there is a lack of information on working human rights in the face of a lack of labor rights education for teenagers. In fact, it is very desirable to learn the meaning of labor in adolescence and experience the scene where actual labor is done, as one can faithfully prepare oneself to become an adult through understanding and experience labor. However, due to their young age, such as lack of social experience, they are placed in the position of weaker under employment contracts, and the possibility of being infringed on their rights in the labor field is very large compared to adults. Therefore, it is necessary to support and protect the growth of healthy and sound youth, and in this regard, local government-level efforts and policy support to lay the foundation for youth labor and human rights policies. In conclusion, youth labor and human rights should eventually be approached from the perspective of human rights, so continuous efforts and achievement at the local government level are needed for human rights governance, which is desirable in the era of autonomy and decentralization.
