경찰청 신변보호제도에 관한 현행법상 문제점과 개선방안

The Current Legal Problems and an Improvement of Personal Protection System of Police for Crime Victim and Witness

경찰청에서 수행하는 범죄피해자 등에 대한 신변보호 업무의 중요성과 필요성은 날로 높아지고 있다. 경찰은 나름 고군분투하고 있지만, 여러 가지 문제점들이 드러나고 있다. 본 논문은 현재 시행되고 있는 경찰의 신변보호제도로 어떤 것들이 있으며, 법률적·제도적 차원에서 문제점은 무엇인지, 이를 개선하기 위한 과제는 어떤 것들이 있는지 검토하는 것을 목적으로 한다. 먼저 경찰의 신변보호와 관련된 선행연구를 분석하고 지적된 문제점들을 정리하여 그 시사점들을 살펴보았다. 경찰이 수행하고 있는 신변보호조치 10종류의 운영실태를 확인하였다. 실무현장에서 빈번하게 발생하는 사례들과 관련하여, 신변보호조치를 위한 근거 법률과 요건 및 절차를 비교분석하였다. 그런 다음 사례별로 합당한 해석론을 전개하고 현행법상 한계로 인해 발생하는 문제점들을 살펴보았다. 개선방안으로 입법적 측면에서 다음과 같이 나름의 대안을 제안해 보았다. 대상자 제한이 없는 신변보호 일반법(조항) 제정, 책무의 중요성에 비례한 예산의 편성 및 집행의 효율성 확보, 실효적인 불복 및 권리구제 절차 마련을 주장하며 구체적 입법모델을 제시하였다.

The importance and need for personal protection work for crime victims is growing day by day. The police are struggling in their own way, but there are many different issues raised with their personal protection work. This study aimed to examine the personal protection systems of the police currently in force, identify their issues at the legal and institutional level, and review their improvement tasks. The study first analyzed previous studies on personal protection by the police, sorted out the issues pointed out in previous studies, and examined their implications. It then gave an overview of ten personal protection measures implemented by the police and checked their actual operation. The ground laws, conditions, and procedures for personal protection measures were compared and analyzed regarding frequent cases in the field. A proper interpretation theory was developed for each case, and issues due to the limitations of current laws were examined in practical affairs. For improvement plans, the study proposed the following alternatives in the aspects of legislation, the study made an argument to enact a general law (provision) on personal protection with no restriction of application for victims, secure efficiency in the compilation and execution of a budget in proportion to the importance of duties, and prepare an effective procedure for insubordination and relief of right, proposing specific legislation models for them.
