심헌섭 교수의 형법사상

Dr. Hun-Sup Shim as a Criminal Law Scholar

심헌섭(1936~2018) 교수는 학계에서 주로 법철학자로 알려져 있지만 형법 분야에도 큰 공헌이 있는 학자이다. 그는 형법학의 주제 가운데 기본적이고 방법론적인 주제에 집중하여 연구하였다. 그 연구의 소산으로 행위론에서 부터 고의 및 과실의 이론, 인과관계론, 주관적 정당화사유의 이론, 그리고 형벌의 정당화 이론에 이르기 까지 심도 있는 업적을 남겼다. 그는 형법학자로서는 해방 후 교육받은 첫 세대의 학자이며 독일 유학의 경험을 가진 학자로서, 한국 형법학 발달에 방향을 설정하고 그 방향의 중요한 디딤돌을 놓았다고 평가할 수 있겠다. 특히 형법학과 법철학의 교차분야라고 할 수 있는 주제(법으로부터 자유로운 영역의 이론, 형법학에서의 켈젠 이론의 해석 등)에 관하여는 새로운 시야를 열었다고 평가할 수 있을만한 큰 업적을 이루어 놓았다. 심 교수의 때 이른 별세를 애도하면서, <형사법연구>지에 그의 형법학을 조망하는 귀한 기회를 갖게 해주신 류전철 학회장님과 형사법제사연구회 문성도 회장님께 감사드린다.

Dr. Hun-Sup Shim, late professor of College of Law, Seoul National University, was well known as a legal philosopher, but he was also a scholar of criminal law, and accomplished remarkable achievements in the field of criminal law. He addressed fundamental and methodological issues of criminal law. His main achievements are as follows: new interpretations concerning a theory of criminal action, mens rea, criminal faults, causation in criminal law, subjective elements of justification, and theory of punishment. He was a scholar of the first generation educated after the liberation from the Japanese occupation. He had an opportunity to study abroad in Germany. It was a rare opportunity for a young Korean scholar at the beginning of his academic career. He tried to wise a Korean way of scholarship of criminal law at the time led by the Japanese bridle, and performed fundamental works in this sphere. His specialty was in cross-over fields of criminal law and legal philosophy, and he opened a new way of interpreting themes. The author mourns his sudden and untimely death and tries to recollect him and his academic achievement in this small contribution to this journal.
