헌법상 대학의 자치와 교회법상의 가톨릭 대학교의 정체성에 관한 연구

A Study on the Autonomy of University under the Constitution and the Identity of Catholic University under the Canon Law

오늘날 입시, 취업 등을 위한 실용주의적인 교육과 정부 주도의 교육정책 등으로 인하여 대학이 대학으로서 누려야 할 기본적인 자치권 확보가 되지 않고 있고, 그 결과 본래 대학이 지향해야 할 본질적인 역할을 제대로 수행하지 못하고 있다. 사립대학인 가톨릭 대학 역시 예외일 수 없다. 무한 경쟁시대에 대학의 존립을 위해서는 자신의 설립 목적인 고유한 정체성마저도 포기해야 할 지경이 되었다. 오늘날 가톨릭 대학의 존재 이유이기도 한 인류 보편적 가치로서의 가톨릭 대학의 정체성을 구현하기 위해서는 필연적으로 연결되는 문제가 바로 대학의 자율 내지 자치의 문제이다. 국가법적으로 가톨릭 대학은 가톨릭 학교법인이 사립학교를 경영할 목적으로 사립학교법에 따라 설립한 대학이다. 사립학교법 제2조 이하. 따라서 가톨릭 대학은 헌법 제31조 제4항이 보장하고 있는 “대학의 자율과 자치”규정에 따라, 대학에 대한 공권력 등 외부세력의 간섭을 배제하고 스스로 대학을 자주적으로 운영할 수 있는 권리가 있다. 또한 그 내용은 세부적으로 인사·학사·재정 기타 학교운영에 관한 전반적인 사항에 관한 것이다. 한편 가톨릭 대학은 교회법상의 공법인으로서 권리와 의무의 주체가 되며, 그 전반적인 운영에 있어서 국가법뿐만 아니라 교회법도 준수하여야 한다. 그러므로 사립학교인 가톨릭 대학의 운영 주체는 교회법과 국가법을 동시에 준수하면서, 설립 목적인 자신이 추구하는 정신·이념·정체성에 따라 대학의 운영에 관한 모든 분야, 즉 구체적으로 대학시설의 관리·운영만이 아니라 대학에서의 임원 및 교직원의 임면, 교육의 내용과 방법, 교과과정에서의 편성, 학생 선발 및 전형 등에 있어서 외부의 간섭을 받지 않고 스스로 결정하고 자신만의 특성화된 대학을 만들어 갈 수 있다. 그렇다면 가톨릭 대학만이 지니는 특성이란 어떤 것들이 있는가? 본문에서 언급한 것처럼, 가톨릭 대학은 다음과 같은 특성을 지녀야 한다. 첫째, 진리 추구를 사명으로 하며, 신앙과 이성이 조화를 이룬 학문연구를 통해 인류문화 발전에 봉사하여야 한다. 둘째, 대학의 모든 구성원들이 가톨릭 교회의 가르침을 존중하며 충실하여야 한다. 셋째, 그리스도교적 정체성이 제도화되어야 한다. 이러한 특성을 갖춘 모든 대학은 실질적인 “가톨릭 대학”이라고 불릴 수 있을 것이다. 기관의 정체성은 무엇보다도 기관을 구성하는 사람들에 달려 있다. 가톨릭 대학은 어떤 시스템이 아니라 신앙과 일치하는 방식으로 일을 하는 가톨릭 신자들에 의해서 활성화되는 기관이다. 그러므로 이러한 책임 수행을 위해서 적합한 능력과 자질을 갖춘 구성원들을 선발하고 양성을 위한 시스템을 갖추어야 할 것이다.

Today, pragmatic education for an entrance examination and employment, and government-led educational policy do not ensure the basic autonomy that the university should enjoy. As a result, the university is not able to accomplish its fundamental role. The Catholic university as a private university is no exception. In the age of unlimited competition, it is indispensable for the university to give up the original identity of its establishment to survive. In order to embody the original identity of the Catholic university as universal values of the mankind, the Catholic university should focus on autonomy and self-government of the university which is essential to its reason for being. In the National Anthem Law, the Catholic university is established under the Private School Law for the purpose of running private school. So, in accordance with the provisions of “the autonomy and self-government of the university” guaranteed by Article 31, paragraph 4 of the Constitution, the Catholic university has a right to run independently apart from interference of governmental authority. And it specifically contains general matters of running school such as personnel, school affairs, finance and so on. On the other hand, the Catholic university is a subject of rights and duties as a public legal person under the Canon Law. And the Catholic university must observe not only the National Anthem Law but also the Canon Law in its general operation. The Catholic university should be able to decide for themselves and create its own specialized university without any external interference in all aspects of the university’s operation in accordance with the mission and identity of its founding purpose. What, then, are some of the characteristics unique to the Catholic university? The Catholic university should have the following characteristics. First, the Catholic university should serve the development of human culture through academic research in the harmony with faith and reason. Second, all members in the university should respect and be faithful to the teachings of the Catholic Church. Third, Christian identity must be institutionalized. With these characteristics, any university could be called a real Catholic university. The identity of an institution primarily depends on the people who form it. The Catholic university is not a system, but an institution activated by Catholics who work in a way that is consistent with their faith. Therefore, in order to carry out the responsibility, it is necessary for the Catholic university to choose the people with appropriate skills and qualities and to nurture them in the suitable system.
