‘학교폭력예방 및 대책에 관한 법률’ 개정 내용과 향후 과제 분석

An Analysis of the Revision and Future Tasks of the Act on the Prevention of and Countermeasures against Violence in Schools

본 연구에서는 2019년 8월 학교폭력예방법 개정의 주요 내용과 의의, 그리고 운영상의 과제를 살펴보았으며, 연구결과를 요약하면 다음과 같다. 먼저, 주요 개정 내용으로는, 학교에 설치하는 학교폭력대책자치위원회 대신 교육지원청에 학교폭력대책심의위원회 신설, 학교폭력대책심의위원회 학부모 구성 비율 축소, 경미 사안에 대한 학교장 자체해결제도 도입, 이원화된 재심 기관 대신 행정심판으로 일원화 등이 해당된다. 이와 같은 개정은 학교폭력 사안 처리과정에서의 전문성, 중립성, 객관성, 공정성 등과 아울러 교육적 해결 가능성을 제고하는데 기여할 것으로 예상될 뿐 아니라, 학교폭력 심의 기능의 교육지원청 이관으로 인하여 단위학교가 교육활동에 집중할 수 있는 환경 조성에도 긍정적 영향을 미칠 것으로 판단된다. 다음으로, 법률 개정에 따른 제도 운영상의 과제로는, 학교폭력대책심의위원회 운영관련 부서의 인력을 확대하거나 관련 업무를 전담할 부서 신설, 학교폭력대책심의위원회 전문가 인력풀 확보 및 학부모 위원의 전문성 강화, 학교장 자체해결제도 내실화를 통한 학교의 교육적 기능 회복, 교육지원청 관련 부서의 학교내 학교폭력전담기구 사안조사 지원 강화, 학교폭력 예방 노력 확대를 통한 법적 해결 방식의 한계 극복 필요 등을 제안하였다.

In this study, we looked at the main contents, significance and operational challenges of the revision of the Act on the Prevention of and Countermeasures against Violence in Schools in August 2019 and summarized the research results as follows. First, as for the main revisions, the establishment of a school violence deliberation committee at the district office of education instead of the school violence self-governing committee, reduction of the percentage of parents in the school violence deliberation committee, introduction of a self-settlement system for school principals on minor issues, and unification by administrative appeals instead of dualized retrial institutions. Such a revision is expected to contribute to raising the possibility of educational solutions in addition to expertise, neutrality, objectivity, and fairness in handling school violence issues, and the transfer of school violence deliberation functions to the district office of education will have a positive effect on creating an environment for schools to focus on their educational activities. Next, the operational tasks of the system following the revision of the act, expanding the operation personnel of the school violence deliberation committee and establishing departments, securing a pool of experts and strengthening the expertise of parents at the school violence deliberation committee, restoring the school s educational functions through internalization of a self-settlement system for school principals, strengthening the support of the school violence exclusive organization in schools, and overcoming the limitations of the legal solution by expanding efforts to prevent school violence.
