FTA 직접운송원칙 준수 방안에 관한 연구

A study on the Principle of Direct Transport in FTA - mainly on the use of new technologies

현재 수입통관 및 원산지검증 시 직접운송 입증은 통과선하증권, 비가공증명서 등의 종이 또는 전자서류를 관세당국에 증빙자료로 제출하여 심사하고 있다. 직접운송과 그 예외를 입증하는 서류는 협정에 규정되어 있으며 증빙서류 제출이 미흡하거나 제출하지 않는 경우 협정관세 적용을 배제하고 있다. 그러나 4차 산업혁명을 통해 IoT, 블록체인 기술 등이 정착된다면 현재처럼 종이서류 제출을 통해 직접운송을 입증해야 하는 번거로운 절차 없이도 운송요건 충족여부가 수월하게 확인 가능하게 될 것이다. 해외 주요국들은 이미 신기술을 도입하여 각 산업분야 뿐만 아니라 해운물류에도 활발하게 적용하고 있으나 우리나라 해운항만은 도입이 늦어져 현재 시범사업 단계에 있거나 초기시장을 형성해 가고 있는 단계이다. 본 연구는 주요 FTA별 직접운송 관련 규정을 살펴보고 직접운송 규정 위배 사례를 분석하여 문제점을 종합적으로 제시하여 원인을 도출하였다. 그 해결방안으로는 기관 차원, 운송사 차원, 업체 차원으로 구분하여 제언하였다. 특히 기관 차원과 운송사 차원의 해결방안에서 제시한 IoT와 블록체인을 통해 컨테이너와 화물의 위치 및 상태를 자동으로 수집하고 분석하여 관련 자료를 거래 참여자 모두가 실시간으로 공유하고 검증할 수 있게 된다면 협정상 직접운송원칙을 준수하는데 있어 신기술 활용이 실질적으로 중요한 역할을 하게 될 것이다.

The principle of direct transport is one of the prerequisites of origin determination criteria. This principle is that the goods should be shipped directly to the destination without transit or transshipment through a third country. It also recognizes exceptions by agreement when certain conditions are met. The Fourth Industrial Revolution refers to the next generation industrial revolution in which information and communication technologies such as the Internet of Things(IoT) and blockchain, etc., bring about innovative changes throughout the social economy. Major overseas countries have already introduced new technologies and are actively applying them not only to their respective industries but also to shipping and logistics. Currently, papers or electronic documents are submitted to the customs authorities to demonstrate the principle of direct transport. However, if the IoT, blockchain technology, etc. are settled through the 4th Industrial Revolution, it will be possible to automatically check whether the transport requirements are met without the cumbersome process of verifying direct transport through paper documents.
