Incoterms?? are a set of internationally recongnised standardised trade terms published by the International Chamber of Commerce(ICC) and are widely used in domestic and international trade. Incoterms?? were first introduced in 1936 and were revised in 1957, 1967, 1976, 1980, 1990, 2000 and 2010 to accommodate changes in the international trade system. ICC has released the latest version of Incoterms??, which comes into force on January 1, 2020. Compared to Incoterms?? 2010, the main changes of Incoterms?? 2020 are as follows: 1. Incoterms?? 2020 provides for demonstrated market need in relation to bill of lading with an on-board notation and FCA Incoterms rule. 2. Where listed, cost allocation between buyer and seller is stated more precisely. 3. Incoterms?? 2020 aligns different level of insurance coverage in CIF and CIP 4. Incoterms?? 2020 includes arrangements for carriage with seller’s or buyer’s own means of transport in FCA, DAP, DPU and DDP. 5. There is a change in the three-letter name for DAT to DPU. 6. Incoterms?? 2020 includes security-related requirements within carriage obligations and costs. 7. “Explanatory Notes for Users” for each Incoterms rule have replaced the 2010 edition’s Guidance Notes. This paper contributes to help the parties concerned to understand the new changes from Incoterms?? 2020 and to choose the appropriate Incoterms rule for a given transaction.
