A Study on Introduction of Autonomous Police System

자치경찰제의 개념은 학자에 따라 다양하게 정의되고 있다. 자치경찰을 ‘경찰의 기능’을 중심으로 정의하기도 하고, ‘지방자치’의 관점으로 정의하기도 한다. 경찰의 기능을 중심으로 정의할 경우, 자치경찰제란 경찰이 지방자치단체의 권한과 책임 하에서 지역주민을 대상으로 공공의 안녕과 질서유지에 대한 치안임무를 자주적으로 수행하는 제도이다. 지방자치의 관점에서 자치경찰제란 자치단체의 능력과 조직 및 인력으로 자치단체에 속한 자치경찰사무를 처리하는 제도라고 정의하고 있다. 이러한 자치경찰제는 헌법 제8장에 명시된 지방자치이념에 부합하며, 헌법 제117조 제1항 및 「지방자치분권 및 지방행정체제개편에 관한 특별법」 제12조 제3항에 따라 제도 도입에 대한 법률적 근거가 마련되어 있다. 따라서 자치경찰제는 지방분권과 지방자치의 중요 요소로서 경찰활동의 민주성 확보는 물론 주민 참여를 통한 지역 친화형 치안 서비스를 확보할 수 있다는 점에서 의의가 있다. 그러나 30년 넘게 맞이하고 잇는 지방자치 시대에 자치경찰제는 그 도입 방안에 대한 다양한 형태의 논의와 문제제기로 지금까지 시행이 지연되고 있다. 지역주민의 생활 주변에서 발생되는 치안 수요를 지역별로 특화하여 맞춤형 치안 서비스를 제공하고 중앙집권적인 국가경찰의 분권화를 실현하기 위해서 자치경찰제의 안정적인 도입은 불가피하다. 자치경찰제가 성공적이고 안정적으로 도입되기 위한 고려사항들을 알아보려 한다.

The concept of an autonomous police system is defined in various ways by scholars. It defines autonomous police as the center of the function of police and as the point of view of local autonomy. In the case of defining the function of the police, the local police system is a system under which the police voluntarily perform public safety and order duties for local residents under the authority and responsibility of the local government. In terms of local autonomy, it is defined as a system of dealing with autonomous police affairs belonging to local goverrunents by their ability, organization and manpower. Such a self-governing police system conforms to the local autonomy ideology set forth in Chapter 8 of the Constitution and provides legal grounds for the introduction of the system in accordance with Article 117 and Article 12-3 of the Special Act on Local Autonomy and Administrative Reform. Therefore, the autonomous police system is meaningful in that it can secure local-friendly security services through participation of residents as well as securing democracy in police activities as an important element of decentralization and local autonomy. However, in the era of local autonomy, which has been around for more than 30 years, the local police system has so far been delayed due to various forms of discussion and raising questions about how to introduce it. The stable introduction of the autonomous police system is inevitable in order to provide customized security services and realize decentralization of the centralized national police by specializing the security needs generated around the lives of local residents. We want to look into the considerations for the successful and stable introduction of the local police system
