본 논문은 2015년부터 2017년 7월까지의 대법원 판례 중에서 각 세목별로 납세자의 권리보호를 위한 의미있는 판결을 소개하면서, 이에 관하여 간단히 평석을 한 것이다. 국세기본법과 관련하여, 세무조사의 처분성을 인정한 판결의 후속판결로서 ①부정한 목적으로 한 세무조사는 세무조사권의 남용에 해당하여 위법하다는 판결(2016. 12. 15. 선고 2016두47659 판결), ② 조사사무처리규정상 현지확인이 세무조사의 성질을 지닐 수 있음을 인정한 판결(2017. 3. 16. 선고 2014두8360 판결)이 있었고, 재조사결정이 변형결정으로 유효하다는 판결의 후속판결로서 ③재조사결정에 따른 후속처분이 불이익변경금지원칙에 반할 수 있음을 인정한 판결(2016. 9. 28. 선고 2016두39382 판결), ④ 재조사결정의 기속력의 인정범위에 대해 의미있는 판결(2017. 5. 11. 선고 2015두37549 판결)이 있었고, 과세예고통지 및 과세전적부심사청구와 관련하여 납세자의 절차적 기본권을 보장하는 의미있는 판결 중에서 ⑤ 과세전적부심사청구 중에 한 과세처분은 위법하다는 판결(2016. 12. 27. 선고 2016두49228 판결), ⑥ 과세전적부심사 중에도 징수처분의 소멸시효가 정지되지 않고 진행된다는 판결(2016. 12. 1. 선고 2014두8650 판결)이 있었다. 마지막으로 ⑦ 가산세에 있어서 대법원 판결이 명확하게 나오기 전까지는 기대가능성이 없기 때문에 정당한 사유를 인정한 판결(2016. 10. 27. 선고 2016두44711 판결)이 있다.
This article introduces some important supreme court about taxation on the view of taxpayer’s right from 2015 to July 2017. The supreme court recently decide the important decision on protecting taxpayer’s right. The are as follows; First, in the area of Basic Law for National Taxes, ① 2016du47659 decided on December 15, 2016 on abuse of tax investigation, ② 2014du8360 decided on March 16, 2017 on approving the field confirmation of tax investigation, ③ 2016du39382 decided on September 28, 2016 on violating Verbot der Reformato in peius when the tax authiorities reinvestigate and impose the taxation according to the tax tribunal’s decision of reinvestigation, ④ 2015du37549 decided on May 11, 2017 on the scope of the effect of sentence about reinvestigation decision, ⑤ 2016du49228 decided on December 27, 2016 on approving the taxation is illegal during the previous notice of taxation review, and ⑥ 2014du8650 decided on December 1, 2016 on not stopping the Statue of Limitation during the previous notice of taxation review, ⑦ 2016du44711 decided on October 27, 2016 on approving on the justifiable reason not filing the taxation before the decision of supreme court.
