운임공표제의 실효성 제고 등을 위한 해운법 개정안이 국회를 통과(2019. 8)하여 시행될 예정(2020. 2)으로 개정안의 취지를 반영하여 해운법의 하위법령인 외항운송사업자 운임공표 업무처리요령(고시)의 개정 추진이 긴요하다. 본 연구의 목적은 운임공표제를 시행하고 있는 다른 주요 해운물류국의 사례를 분석·검토하고, 이를 통해 우리 운임공표제의 실효성 제고를 위한 해운법 하위법령인 외항운송사업자 운임공표 업무처리 요령(고시) 개정 방안을 도출·제시하는 것이다. 유럽, 미국, 중국, 일본 등 주요국은 자국 해운·물류 사업자의 국제경쟁력 강화를 위해 다양한 운임 안정화 조치를 강구해 오고 있으며, 특히 운임공표 제도의 실효성 제고를 위한 운임공표 업무처리 요령의 정례적인 개정을 추진하고 있다. 해운산업의 건전성 제고와 공정한 운임질서 확립을 위한 제도적 장치 마련 등을 위해 운임공표요령을 개정할 필요가 있다. 본 연구는 다양한 해외사례를 분석하고, 해운산업의 건전한 발전 등 운임공표제의 도입 취지(1999년 도입)에 적합한 덤핑방지, 정상운임 보장 등 구체적인 개정 방안을 제시하고자 하였다. 본 연구는 불공정·과당경쟁 방지를 통한 공정한 시장 경쟁질서 확립 및 해운산업의 건전한 발전 도모 위한 제도적 수단(업무처리 요령 개정안)을 마련하는데 기여할 수 있을 것으로 기대된다. 본 논문은 해양수산부에서 발주하고 한국해양수산개발원이 수행한 ‘운임공표제 실효성 제고 방안 연구(2019. 9. 5∼2019. 12. 3)’를 토대로 분석·작성되었고 구체적인 하위법령(운임공표 업무처리 요령) 개정 방안을 제시하며, 본 논문에서 제시하는 개정 방안을 토대로 2020년 상반기 실제 개정 예정에 있어 해운 경쟁력 강화를 위한 우리나라 정부의 해운재건 5개년 계획(2018. 4.)과도괘를 같이 하고 해운 재건에 일조할 수 있다고 기대된다.
The revision of the Shipping Act to enhance the effectiveness of the seaborne freight announcement system will be implemented 0n February 2020 after passed by the National Assembly on 2019. 8. And it is vital to revise the Korean Government Guidelines for Freight Announcement System for reflecting the intention of the revision of the Shipping Act which is a subregulation of the Shipping Act. The purpose of this study is to analyze and review the cases of other major shipping and logistics countries including Denmark, US., China, and Japan that implement the national freight announcement system and to draw up measures to revise the current Korean freight announcement system that are helping stabilize the freight market and develop the shipping industry. Major developed shipping and logistics countries such as Europe, the U.S., China and Japan have been exploring various fare stabilization measures to strengthen the international competitiveness of their shipping and logistics operators, and are pushing for a regular revision of their countries’ freight announcement system to enhance the effectiveness of their seaborne logistics market. This research is expected to contribute to the establishment of a fair market competition order through prevention of unfair and excessive competition and the establishment of institutional means to promote sound development of the shipping industry through proposing by presenting specific improvement measures like examples that have already been proven successful overseas. In summary, due to the prolonged slump in the shipping industry, the management performance of Korean shipping companies is worsening, and it is urgent to enhance the stability of freight rates as stable management activities are not possible due to the deepening freight volatility. This research has drawn up a complete revision of Korean Government Guidelines for Freight Announcement System to help readjust and reform the freight service announcement system and to help Korea’s shipping become more competitive.
