사우디아라비아의 국적법 연구 - 국적취득과 상실을 중심으로-

A Study on Nationality Law in Saudi Arabia: The Acquisition of Nationality and Denationalization

본 연구는 사우디아라비아의 국적법이 어떻게 구성되어있으며 어떤 내용을 담고 있는지를 취득과 상실의 측면에서 살펴보았다. 사우디는 모법인 국적법과 시행령을 제정하여 상호보완적 역할을 하고 있으나 국적법이 가지는 입법목적이나 내용이 구체성을 띠고 있지 않다. 이는 모든 법률의 법원을 꾸란과 하디스에서 찾기 때문이다. 그러나 타 국가들이 채택하고 있는 국적취득, 국적상실, 복수국적, 국적회복, 귀화 등 법률내용을 대부분 담고 있어서 국적법의 체제는 갖추고 있다고 본다. 사우디는 국적취득에 있어서 부계혈통주의를 채택하고 있으며 그간 사우디아라비아는 외국인에게 국적을 부여하는 것을 금기시하다시피 하였다. 그러나 ‘사우디아라비아 비전 2030’을 추진하면서 국가경영발전에 필요한 우수인재확보가 중요한 요인이 되었다. 과거와 비교하면 귀화조건의 문턱을 많이 낮추어 인재확보의 길을 열어놓고 있다.

This study attempts to examine nationality law of Saudi Arabia, paying particular attention to the acquisition of nationality and denationalization. Compared with other countries, the legislative purpose or content of the Saudi nationality law are not detailed because Saudi Arabia looks for sources of all laws in the Qur‘ān and Hadīth. However, the Saudi nationality law is considered to have a system like other countries in the legal details such as acquisition of nationality, denationalization, multiple nationality, nationality restoration, and naturalization. Saudi Arabia has forbidden the granting of nationality to foreigners. However, as Saudi Arabia seeks talented foreigners in executing national development projects under Saudi Vision 2030, the requirements for naturalization have been considerably lowered.
