견제 받지 않은 권능과 권한을 가진 검찰은 어느덧 거대한 권력기관으로 변모했다. 검찰은 수사권, 특별사법경찰관리에 대한 수사지휘권, 수사종결권, 체포·구속장소 감찰권, 변사자 검시권, 영장청구권, 기소권, 기소재량권, 형집행권 등을 가지고 있다. 그 뿐만 아니라 검사가 직접 지휘할 수 있는 검찰청 소속 사법경찰관리와 같은 수사인력과 과학수사 등을 통해 검사의 수사를 지원하는 지원인력까지 보유하고 있다. 이러한 조직이 북한도 아닌 우리나라에 지금 이 시대에 존재하고 있다는 사실은 검찰 적폐와 기득권이 얼마나 타파하기 힘든 것인가를 우리에게 보여주고 있다. 일제강점기를 통해 전해진 일본 검찰의 유산을 물려받고 군사정권을 통해서 막강한 힘을 갖게 된 것이 오늘날 우리나라의 검찰의 모습이다. 공수처는 어찌 보면 하나의 미봉책에 지나지 않을 수도 있고 옥상옥이 되는 제2의 검찰조직을 만드는 것일 수도 있다. 그러나 지금은 검찰권을 견제하고 공직부패를 척결할 수 있는 새로운 모델의 출현이 그 어느 때보다 절실한 시점이다.
We believe that this law will develop a new aspect that we have not seen in the past. A new type of crime control model could be created in which the three-way system of the OIA, the prosecution and the police can eliminate public office failures, as the prosecution, which has so far exercised its power, is subject to some outside control. This could affect the area of criminal justice in many countries, just as Korean wave(HanRyu) has affected the world. This could be a shock to those who are mired in academic toadyism and are negative about making new standards and procedures, considering only some of the foreign prosecutorial systems as gold and jade. After the law is enforced and the “OIA Rules” are issued, the outline of matters related to duty, authority, action and crime control, including investigations and prosecution of public officials, relations with investigative agencies such as the prosecution and police, and the emergence of a new crime control model by the three-way system, will be revealed in more detail, with more opportunities to obtain practical research data. Therefore, as it is now before the law s implementation and the “OIA Rules” have not yet been established, the related issues will be put off to the following follow-up studies, which will look at problems that are expected after the law s implementation, mainly through systematic approaches to examining the agency.
